Agency that exists in every State or Tribe to locate noncustodial parents (NCPs) or putative fathers (PF), establish, enforce, and modify child support orders, and collect and distribute child support money. It is operated by the State, Tribal or local government according to the Child Support Enforcement program guidelines as set forth in Title IV-D of the Social Security Act. Also known as a “IV-D Agency”.

Answer: In my state if you don't pay...you go to jail. Not having a job means nothing. Your new spouse will not be held responsible for your child support.

Question: Role of Child Support Enforcement Agency? I paid my court ordered child support for 13 years as was my legal, and moral, obligation. In fact, I have a balance with the Child Support Enforcement Agency (CSEA). During those 13 years, I lived 1100 miles away from my child (I’m in the military) but did everything I could possibly do to maintain a relationship (phone calls, holiday cards, gifts, vacationing near my child, etc...). Recently, I moved closer to my child (less than 200 miles away now) and came to the gruesome realization that the mother of my child had literally given my child to someone else. To make a long story short, after a horrendous juvenile court case, I now have custody of my child (14 years old now). I, and my child’s mother, was accused of Child Abandonment by the woman that raised my child. Since the mother and the other woman made every attempt conceivable to conceal my child’s living arrangements from me, I was not found guilty. Instead, my child was found to be “dependent” due to the distance between us. Despite all of this, the simple fact of the matter is I paid my child support for 13 years to a woman (via the CSEA) who did not, in turn, provide support for my child (that little tidbit came out of the court case).
I was never given any indication that my child was not being cared for by his mother. Neither was the rest of my family. The woman that did raise him never reported the mother to CSEA or reported my child as abandoned to the local law enforcement. She merely decided to keep my child and raise my child as her own (that also came out in court).
I’ve been ripped off! Mind, you, I do not refer to being ripped off in the financial sense. Since the day my child was born I have been capable of providing a life to my child with a loving father. The fact that I was in the military is moot as I married a year after my child was born. Two women, whom I strongly believe need psychological counseling, decided that I didn’t need to be a father.
Now that I’ve provided a little bit of background, I am quickly approaching my question. I’ve searched the internet far and wide for state and federal child support enforcement laws and regulations and the only thing I can find conclusive support of is that child support will be collected from the parent ordered to pay. So here is my question; what assurances, if any, is the CSEA required to make so that the person supporting the child is the person who receives the child support? Note that I’m not asking how I can determine that my child support is actually going to the support of the child. It should be quite obvious from the background I’ve provided that my child support did not go to the support of my child at all.
The reasoning behind my question is simple. If there are policies and laws in place to ensure a child is properly being cared for by the custodial parent, I can only assume had those policies and laws been enforced, I would have been notified through the CSEA or some other agency a long time ago that my child was in need of parental care.
Answer: This entire scenario is a nightmare in more ways than just the legal aspects. You have some excellent points and I seriously doubt anyone, regardless of well meaning intentions, could possibly give any answers that could be upheld in court.
Best and only advice would be to get a consultation with an attorney. Lay all the details out for him and see where you stand in all of this. I could easily see civil and criminal charges resulting here for the mother of the child.

My ex-wife filed for divorce in 1998. Court had no knowledge of divorce until recently discovering it online by communicating with IL. Child support court order originated in Dane County Madison, WI. Dane County collected child support from me begining in 1994 until 2006, and now says it should have not been involved from time of divorce and has suspended further actions because of 1998 divorce which was filed for in IL. Question is: "Can money which was taken from me from 1998 until 2006 be classified as money confinscated under false pretense?" "If so can Agency be sued for false involvement, and for money gained in that measure?" The child-support enforcement agency is so dedicated to collecting from me that it was not concerned if it was in violation of it's grounds to act, for they imediately suspended themselves becuase of divorce.
Answer: Regardless of when or how they got the money, if that's all you're providing for your child(ren) I would just GET OVER IT. You made the child(ren), too. Don't go after getting the money back, that would only make them resent you. Unless you really are heartless and just don't care.

The mother did not start the case but she was collecting welfare from the state. I was in the process of serving her with court papers to establish paternity, support, parenting time, and joint-custody. I was paying at least half for all of my sons necessities but she was still collecting welfare, instead of finding a job, even though I had watched my son in the evenings. Therefore, the district attorney served me with court papers. Ironically, once the ball started rolling the mother of my son decided she was going to leave town. I served her with a court order to not leave the state but she left anyways, and anybody who knows anything about court orders knows that they are worthless out of state, unless they are federal or criminal.
Anyways, she has not showed up to court ordered genetic testing. A hearing was scheduled but now they are pushing it back to see if they can get her to do genetic testing still. They said that if she does not show up they will just cancel her welfare and drop the case.
I have studied government literature and it says that states can take advantage of limited services from other states. People I talk to at the child support enforcement agency seem to not know about this or care. If they are not willing to do what is necessary, inter-state, then are they really concerned with child support? Because of this, my son is in the situation that he may not have any support.
The lady told me, "We don't normally go after the custodial parent." Well, are they really concerned with my child or the custodial parent?
Laughter_every_day: No, you got it wrong. The agency is supposed to be there to support children. It isn't an issue of who owe's what in every instance of the policy of the agency. It is an issue of whether or not the child is being supported by both parents. According to their websites it is about fighting for the child to be financially supported by both parents.
So, who is the support for? My child or the custodial parent? Is it about establishing support for my child or for the custodial parent? Or for the agency? It is either one or the other. The agency claims to be concerned with the support of a child.
Also, there have been motions in the past filed with the court by the district attorney making the custodial parent a third-party defendant, making them have to answer for not showing up for genetic testing.
The court system is concerned with the child as well, supposedly.
This isn't about having psychics it is about doing their job for my child.

Answer: File something with the court! There has to be a court order. You can find the case number through www.nmcourts.com if you don't have it readily available.
You really need to talk to a lawyer about this. Where are you in New Mexico? If you're low income, NM Legal Aid has offices all around the state and, if you're not, then maybe the State Bar Association (1-800-876-6227 and 1-505-797-6000) can help you.

Answer: Both types of agencies, governmental and private, have access to the same information, but each has benefits over the other. Most child support investigation firms (private agencies) don't get paid unless they collect, and since they have fewer cases, they tend to work harder at getting the job done (harder=quicker). However, one thing the private agency doesn't have that the government agency does have is the capability to learn of updates real-time. For example, if Joe Smith has been out of sight for 5 years, and then all of the sudden gets a job, the social security administration and the state he's working in, will update a national database immediately...the governmental child support division will learn of this new information in less than 24 hours...whereas a private agency will eventually learn of the information, but only because they physically do the search...if they did a search 10 days earlier, then all of the sudden joe smith gets that job, the states going to know immediately, but the private guy's not going to know for another 3 months when he pays to update his files. So, in this situation, the government would prevail quicker than the private guy. In my opinion, no one should pay for a service that's offered for free by the government. You're own taxes are already going towards the service the government offers, so why not take advantage of it?
And on a final note, in most states, if a private agency finds property, or wants to have a person's driver's license suspended for unpaid support, then he is going to have to go thru the governmental agency anyhow. The child support governmental agency is the only party allowed to initiate punishment such as suspending a drivers license, holding an IRS tax refund, putting a lien on a home, etc.

Answer: Good luck with that. That's what happens when you have to deal with a government agency. They don't operate like a normal business because they don't have to. They don't have to care about promptness, customer service, or satisfaction because they will never go out of business.
Question: Is it better to use a lawyer or the Child Support Enforcement Agency? Answer: There's no charge for child support to establish the case. They get 15% in federal matching funds for handling them, of which they spend only 25 cents on the dollar received from the feds on the programs. As for charging you, Judge David Grey Ross, Commissioner of the Federal Office of Child Support Enforcement advised the states to stop doing that.
They will file for retroactive support because that makes them more money. They file for up to 18 years of retroactive child support on men who didn't know they had a child with a woman, amounting to tens of thousands of dollars. Even against a man who got a woman pregnant who had sex with him when he was 12 years old. Over $80,000.
The problem is, child support enforcement will only address child support, and nothing else. Using an attorney could get all the issues addressed at the same time.
Now, you could inform him that you will be doing it, if the two of you don't come to an agreement that can be registered with the court, with him paying through the court. This can be done using a certified mediator.

Don't let him give you any crap about getting the child. Unless you live in Arizona, single fathers have ZERO rights to the child until granted them by the courts. I know because I teach them how to get it. But, if you don't take care of this in mediation, and he does file for those rights, it could get expensive for you in attorney fees.

Question: How do I move forward from a child support enforcement case number to an actual order for support? I've been separated from my husband for a year, in the process of divorcing for 6 months. The child support enforcement agency finally sent me a case number (after 11 months of sitting on their hands), but now they are saying that they need to verify his address (the one I gave them) with the post office and then they will proceed with the case and they told me to call back in 30-45 days. Answer: Yes, the waiting is inevitable. In my experience, they say they have to verify, they go to serve at his home, he's not there, they go to work, he's not there, he quits job, moves away, process starts all over. I call agency, get voicemail, box is full, please try again. blah, blah, blah. The kicker is when they say, "if you have an address for him, please call us". I'm thinking this is their job, right? But nonetheless, if you can make it all work without the support, and just keep pushing on and be your kids' mom, it all works out in the long run. My son is now 26 and I am still getting back support. The wheels of justice turn slow.
And you can pray for a breakthrough for your ex that he will turn into an upstanding individual who you will not have to pursue for support.

I work hard to provide for my child. I give her a roof over her head, clothes, food in her belly, health insurance and so forth. I also go to school at night to finish my degree so I can provide more for her. WHY should I be paying to support your child while you let the father off scott free?!

Question: Child Support? My ex husband is required by court to pay $420 a month. He is now behind $7,800.00. I have been in close contact with the child support enforcement agency, however everytime thay attempt to serve him papers he simply wont answer his door. He has no job, he didn't file taxes but he did just have another baby. Is there anything alse I can do? I can't afford a lawyer.
Any time he gets a job it takes the process atleast 3 months to start deducting out of his paycheck and usually after the first deduction he quits his job!
Answer: Keep calling the child support division. Even if you have the same info or ask the same questions. You shouldn't have to hire an attorney. Don't give up but don't let it run your life either.
