Cross Examination
Following the direct examination of a witness, cross examination is the follow-up questioning (?examination?). If your lawyer is conducting a cross-examination, that means the witness was first called by the opposing side. For instance, after your spouse testifies during direct examination, your lawyer has the opportunity to cross-examine. As you know, these can be messy since the rules of evidence allow almost anything that will impeach the witness.
Question: What Is The difference between Direct examination and Cross Examination? What is the difference bettween Direct examination of Crown Witness
and Cross examination of Defence witness.
Answer: Direct is by your own atty, or the prosecutor if you're a plaintiff's witness. Cross is by the opposing side's atty or prosecutor if you're a witness for the defense.
Question: How can I make good Cross-examination questions? I'm doing a debate and was wondering how I can create and say a good cross-examination question that makes the opponent look stupid and me look smart and correct? Please help me!
Answer: What kind of debate? I do LD, and I'm not too bad at CX, so I'll try to help you with that.
First off, there really isn't much you can prepare ahead of time, minus a few questions.
The main ones deal with the value and value criterion.
Value Questions: First off, does the value link to the resolution? If not, ask how it does.
EX: Resolution: It is morally permissible to kill one innocent person to save the lives of more innocent people.
One value I ran across was justice. However, justice wasn't really stated in the resolution. Morality was, on the other hand. I asked my opponent how justice linked to the resolution, and he/she (don't remember which) said justice leads to morality. This lead to a little debate on whether justice = moral permissibility. That's unimportant. But the judge ended up judging using my value of morality because it was clearly linked to the resolution. So that's one possible question.
Value Criterion Questions:
1. Is there a link to the value? If not, ask for it. Find out how it achieves the value. If it doesn't, in the end, you can just say, "My opponent can't link his/her value criterion to the value, so even if he/she does win all of his/her contentions, it doesn't matter to the round, so I automatically win on that point." (This can also be said for the value question, if the value doesn't link to the resolution.)
2. How can your value criterion be achieved?
This is important because you need to fully understand what your opponent's value criterion is so you can tear it down properly. Some judges (lay ones) will think you're a bit stupid, but in this case, it is worth it. Trust me.
3. Can your side achieve the value criterion that your opponent has? This is a very important question!!!!!!!
There have been many times where I won because my opponent had an abusive value criterion. What does that mean? Basically, only my opponent could achieve the value criterion, and I couldn't.
EX: Same resolution as before.
Affirmative VC: Respecting human life.
What CX looked like:
Me: How can your value criterion be achieved?
Aff: By saving more lives.
Me: Then how can the negation achieve it?
Aff: It's impossible.
And there we go. I won because I proved that the value criterion was abusive. Well, really, my opponent did by saying it's impossible. However, some people are weird and just say, "That's your job." In those circumstances, just move on.
Okay, so you've asked for how to create one. Here's what you do (other than just adjust my questions for your opponent).
First, look for something contradictory. If there is something contradictory, then ask them about it. Make it work for you.
If there is nothing contradictory, ask your opponent to rephrase a card in their own words. Trust me, it can get really funny. If you're in novice, some people do not know what their cards say and just make up stuff. It usually either contradicts with what the cards say (which you should be able to point out because it's on your flow) or say something that does not relate to the card. In those circumstances, ask them where it said anything like that in the card. They'll just start acting really stupid.
Hope that helps!
Question: What happens if you get an objection on a cross examination? I'm going to Trial on Monday for a bogus DV case, I know I will get an objection when I'm doing the cross examination, but I just want to paint a picture for the jury.

Question: What are some good cross examination questions for debate? I need some good cross examination questions for the topic "Laptops in elementary school" I am against this topic (cons side).
Answer: How can we filter every site? (The filter system now can be bypassed)
What would be done to prevent damages to the systems? (Kids can be messy!)
What is wrong with the current system? Why do we need laptops in every school compared to the desktops in computer rooms we have now?
How much would this cost? Where are we going to get the money for it?
Would laptops be more beneficial for elementary students or high school students? Some high schools don't have great computer systems. Shouldn't they need it more?
Question: Can someone tell me the meaning of cross examination and direct examination? Does cross examination mean ur defending the witness and the direct examination means ur accusing the witness?
Answer: Pretty much the opposite. You're not necessarily accusing or defending a witness--but direct examination is questioning of your own witness and cross examination is questioning of another party's witness.
Question: I have to write a 5 minute essay about cross examination debate? I need help with some good thins about being in cross examination debate, so far my essay is only 40 seconds :/ and I need help with it, any suggestions?
ohh im in the 9th grade by the wayyy idk if that info was needed..
Answer: Cross examining is cutting to the heart of the matter. When, why, where, how, who and for whom or what purpose? Typically, if your question involves cross-examination in a legal setting, cross-examining someone is an attempt to expose the truth in whatever was said previously as the prosecution normally has "volleyed" questions to whomever is on the witness stand in an attempt to show a tender or innocent side that was most likely rehearsed. Cross-examination is the opposite of rehearsed testimony. It is bare-knuckled interrogation and a probe for useful facts or irregularities.
Question: Can you give me arguments and cross- examination questions for my debate? It's about how drug testing SHOULD NOT BE MANDATORY in schools. I was forced to be on this side. PLEASE HELP. I need as many cross- examination questions as possible, yes or no questions only. Thanks :)
Well, in my AP class, it's either a yes or no answer, or you have to further explain your answer, and it's definitely easier if it's only yes or no questions. :D
Answer: Cross examination? Do you mean cross fire?

Question: I am doing a World War I cross examination? I am doing a world war I debate for history defending Austria Hungary, my role is the cross examination and am In need of questions that would prove other countries responsible (Ex. Black Hand with serbia, Shlieffan Plan with Germany) and have to incorprate questions with the knowledge that we all posess, could someone help with trying to construct a question against one of the other countries involved in the outbreak of World War I to help my purpose of defending Austria-Hungary
- I no this is hard but all help is appreciated and even if you dont have a question then any information that i could use to help my case would also be helpful
Thank You so much
Answer: Sorry to disagree with the previous answer, but you're only way out is to blame Germany. There is substantial archival evidence of Germany's manipulation regarding Austria-Hungary's response to Serbia concerning the assassination. The German General Staff and Chancellor Bethmann-Hollweg were directing Vienna at every step with the intention of inciting the larger war, a war which the Germans thought was inevitable (with France and Russia). Read the cables between Berlin and Vienna and you'll discover who was pulling the strings. Incidentally, at the last minute the Austians defied the German General Staff and marched off to Sarajevo (instead of rushing to the East to slow the Russians as the Germans wanted), and promptly got their butts kicked by the Serbs....a sign of things to come.
Question: can someone please think of a good cross examination question? can someone please help me think of a good cross examination, the topic is "laptops in elementary school" PLEASE HELP ASAP!

Question: I need cross examination questions for debating? I'm making a master cross examination list for my team of 3 people. our resolution is "BIRT Willy Wonka is treating the Oompa Loompas like slaves". it's really hard to think of q's cuz it's a really original resolution. i really need help. and my intro needs to be 4 min. but i only have one... will that take off points?
Answer: yes, that is a really unique question...and yes having an introduction that is supposed to be 4 min and you have only one will lead to point deduction. As for the questions you could think about this: 1) Did the Oompa Loompas willingly agree to work for Wonka, knowing the tasks that they had to do? 2) Do the Oompas seem to look mistreated? 3) What are the Oompas getting out of working for Wonka?
Question: what questions would i ask a police officer during cross examination to win my case? i have trial in the morning 2/10/10 at 8:15am for a traffic ticket i didn't get. i have 3 vehicles and while i was at work there were family and family friends at my home. someone took one of my cars got pulled over and this person didn't have my license and gave the police officer my drivers license number and the officer cited this person and let them go. i have trial and get to cross examine this officer. what questions would i ask him to win my case? can anyone please help me!
Answer: The first thing you would need is the person who used your license number and they could testify that you were not the one driving, first I would ask the officer to identify the driver in the courtroom and when he cannot identify you the case will have been won, ask for any video tape evidence as all squad cars have cameras and take witnesses that you never left in a vehicle case won.~

Question: On a cross examination what are the best ways to box your opponent in? I know to ask yes or no questions but it's a lot harder to break my questions down and get little bits of information from each one and tie it all in on closing. I know this has been vauge but i can't disclose the case. Any suggestions?
Answer: first decide what conclusion you want to display to the jury. figure out what they've been exposed to to begin with...so you make your start and end points...diagram a long series of simple questions that makes a concrete and liniar connection to these two points (with overlapping sub-facts) making moves for a variety of predictable responses. after you've made the connection go back over your conclusion (to sum it up for the jury be somewhat repetitive, but not belittlingl) barrage whoever is testifying so they don't have time to think, and DON'T lead anything.
Question: What is the difference between direct examination and cross-examination? In law, what is the difference between both?
Answer: Direct examination is when your own lawyer questions you.
Cross examination is when the opposing lawyer questions you.
(This is the difference/true no matter which, "side," your on.)
Question: If you know anything about debating or policy debate can you help me with my cross examination? Ok when i read my evidence I try to read it as fast as I can but I can't remember what I read, so when I get cross exed I don't answer the questions right! so what should I do in order to memorize a piece of evidence that i only read once?( for example 1 or 2 negative)?
Im a novice if that helps!
Answer: Well first of all if there is a question you don't know the answer to you say my partner will answer in their upcoming speech. But you should always be a little familiar with what your reading. Take a minute or so of prep time to skim through what your reading at least you'll know the basics. You also can't just go up and read the DA or whatever you may be reading. You have to know how and why it relates to the person case you are going against. A lot of times that's what the questions come up to. And worse case scenario you can just flip through what you were reading. Most of the time the answer is right there.
You don't have to have the information memorized you just have to be convincing. And never ever ever just make up an answer always say "My partner will answer in their upcoming speech." When you say that though make sure that they actually answer it in their next speech.
