Question: Must all wills go through probate court? I thought this was the whole idea of a will in the first place, to make everything plain and simple, and so everyone will know what goes to who. I understand if there is a dispute, but if everyone is in agreement with the will, why have to go through this? A will is a legal document, that is the point.
Answer: Wills to not transfer legal title to property. Only court orders can do so. The will simply tells the court what the deceased's wishes were. Not all wills must be probated. If there are no assets or minimal personal property & everyone agrees to disposition things can often be taken care of without a will. Many states have abbreviated procedures for small estates. But if there is real estate; claims against the estate; possible taxes due; minor beneficiaries; charitable bequests, & the like, you have to go thru the court.
Question: My ex served me with court papers. Can I request production of his documents and a Financial Statement? He is claiming he has less income with his new job. However his new job is fast paced and undoubtedly he will or already has received a raise.

Answer: You need to give more info. What did he serve the court papers for? What is he asking? Does he want child support lowered or something? The court will ask him for proof of financials. They don't just take your word for it.
Question: How to coordinate document production better? In our department, we produce reports written by various people, and coordinated by a country manager for that particular report. The country manager provides original text, tables, and figures for the report, which our editor reviews and edits, and then we "format" the various elements, meaning we clean up the text using Word paragraph styles and so on, according to our style manual, as well as formatting tables and figures (graphs) to make them consistent and compliant with our style manual, and put it all together into a cohesive publication.
The process usually doesn't go very smoothly, however, with several rounds of corrections before and after formatting, and sometimes there's confusion about which chapters (each chapter is its own Word file) have or have not been edited.
Is there a software package that would allow us to better organize our document production workflow? One that might enable us to "check out" files while they're being edited or formatted so that no one else can make changes or copy the files to work on?
We've thought of organizing things in folders, but people can still make "unauthorized" edits to the files, etc.

Answer: There are literally tons of document control software suites out there that your company can use. Most of them offer varying lists of features, but one of the basic features is the checking out and in of documents which would prevent somebody from making changes to the document at the same time somebody else is.

Answer: The rules concerning production of documents in discovery vary by state, and, if the rules are silent as to any specific item, the attorney will set his or her own policy.
Ordinarily, the attorneys for the two sides work out the way documents are inspected. In many states the most common practice, unless the volume of documents is huge, is that each side simply makes copies for the other.

Answer: Sure they can. Production of Documents is a standard portion of the Discovery process in a lawsuit. This is where you request any and all documentation, records, reports, receipts, etc etc that will aid in proving your case. When a lawsuit is filed, there is a timeline given by the Court that dictates when the Discovery cut-off date is, among other important dates in the litigation such as Case Evaluation.
During the Discovery process, either side can request anything that will aid them in proving they aren't liable, or that the other party is. This may include the defense requesting hospital records of a plantiff to prove that his alleged injury was partly caused by a pre-existing condition and, therefore, the defendant would not be solely responsible for the injuries sustained. The Plaintiff may request police reports to prove negligence on the part of the Defendant in a car accident.

Answer: It means that you MUST turn over those documents specified in the order. This follows a Request for Production of Documents that was either ignored or incompletely answered. The requesting attorney then calls the other party and tries to get the requested documents without involving the court.
If that doesn't work, then the attorney will file a Motion to Compel Production of Documents wherein he states what documents he is requesting and why they are relevant. The other party will have a chance to argue why those documents should not be disclosed. The court will take a look at the situation and decide whether or not they must be disclosed.
If you don't comply with the Order, you will find yourself on the wrong end of a contempt order and subject to fines or even more serious sanctions.

In the division of property stage of an already-granted divorce in CA, I am the petioner, and wish to serve a request for production of documents on the respondant. Can I draw up my own letter listing my requested documents and mail it to the defendant?

Answer: The divorce is already granted, therefore, there isn't a need for any additional discovery information. If there is another action that you need to begin, see a lawyer, but no, getting a request for a production of documents from an individual pretty much means nothing, and will be taken as nothing. There is nothing governing your request for this discovery.
Question: Being sued over credit card, went to court after filing a subpoena for production of documents.? I am being sued by a law firm representing a collection company. I filed a sworn denial last time and the case was set for a later date by the plaintiff (lawyer). I filed a subpoena for production of original documents before the next court date (although I do not believe they had time to receive the subpoena as I filed it a week before). I went to court and my name was not on the docket even though that was the date set by the plaintiff(attorney). She was so apologetic once I addressed her to ask why my name wasn't called. She set the date for 6 months from now to allow them to produce original documentation, so I left.

Could I have asked the case been dismissed since I believe (by her actions and consistent apologies), she forgot to put the case on the docket w/ the courts?

Answer: It sounds like you are in real civil not small claims, if the case, then a judge can extend the trial date for discovery related issues, so in your case highly unlikely the judge would have dismissed the case at that point, but after six months if they can not produce the documents you stand a better chance on your motion to dismiss, assuming it’s a critical element in the cause of action under which the complaint was filed

Answer: You need more help than you can get here. Also, procedures vary depending on the court/state you are in. Even attorneys refer to practice guides. Go to a local law library and ask the librarian to direct you to an appropriate resource.
Question: plaintiff received Interrogatories request of production of documents by the defendants attorney. ? This is a custody battle over a 15 yr. old child and the defendant(father) has no witnesses and no information to use at the hearing. Answer: Yes!!! You have 30 days to return the interrogatories and to produce document. What they can do if you do not is write a motion called a compel. This means the judge is asking you answer the questions and if you don't return by the time he is requesting you can also be sanction for attorney fees. The dummy interrogatories will cost you to pay his attorney hundreds of dollars. The attorney will present cost and fees. Answer: If the SOL has expired you have an affirmative defense. How you would file your answer would be based on the rules of civil procedure for the court.

Question: Can a person object to a Motion to Compel? I received a Notice of Motion and Motion for Order Compelling Production of Documents. The affidavit is filled with a bunch of untruths. How do I combat this? Do I simply file an answer to each of her accusations, the way I would fine a normal answer? Can I do that?
Answer: Why wouldn't you respond the same way you respond to any other motion? You always have the right to object to any request for a motion by the other side. If you have a compelling argument against producing the requested documents, then you may present it to the judge and have it considered as part of the decision. The judge has the final say. If the judge grants the motion, you must produce the requested documents, however, or be held in contempt of court.
