Question: Annulment.? I don' t know where my wife is. I am planning to file for annulment based on fraud. Does anyone know these two things?
1) Can an attorney who files my papers be in Florida but at the same time do everything according to the laws of the state where papers are filed?
2) Do police serve the papers to my spouse or these are just sent by regular mail to the her last known address?

Of course, I am not turning to you to help me decide. And the people I consulted with a professionals. The thing is that every attorney tries to get me into the whole complect in order to make more money. Now, the attorneys who mostly deal with paperwprk tell me that I will not even have to go to court as there is no fighting over anything. We have no children, and the house is officially mine. Answer: It is almost like a divorce. I had considered one before and since I didn't fit the terms of one, later we got a divorce. With annulments you have to prove what your charging, either fraud, mental, or whatever at the time of the marriage. If they can't find her they will run an ad in the local paper where you think she might be. Your lawyer can be from any state, but each state has their own guidelines. One party has to go to court whether you have property, children, ect.

Answer: you will have to prove that you lived in Ohio for a bit, not sure how long, most of the time its six months. But go up to the court house in the county you reside and get the paper work.

Answer: That depends.
The old fashioned annulment made the children illegitimate in the eyes of the church. Essentially an annulment means the marriage never existed, so the kids were essentially made outside of wedlock.(Anyone who disagrees should ask a priest about this.)
If you are not Catholic yourself, or are not devout, then I am guessing this won't bother you. But some people go for the legal divorce, and not the religious one on those grounds.

Answer: If there is no specific check place for the status you are in, write in letter the reason staing why and what status you are in. This is the best way, simply because the applications are case specific; meaning its case by case, therefore, if you have a specific situation, the letter can help you separate yourself from everyone and they may treat you special and hold your file until your annulment papers are in and not think you are a fraud.
You can also just pen in the 'Annulment in Progress'. Documents may be needed to prove but, until you have completely dont the annulement, they may require you to show/prove your documents.

Annulments are typically available under the following circumstances:
You and your spouse are close biological relatives, The precise parameters of the relationship which will qualify a couple for annulment will vary between jurisdictions.

If your friend consumed marriage then it maybe problematic to get annulment, but divorce will do same make them single again.

The Catholic Church believes that God does not recognize civil divorces.
Jesus said, "Therefore what God has joined together, no human being must separate." (Mark 10:9)

The term "annulment" is a misnomer because the Church does not undo or erase a marriage bond.
Rather the Church issues a declaration of nullity when it discovers that the parties were not truly joined by God and hence a full spiritual sacramental marriage as understood by the Church was not present.

Grounds for nullity include:
• Either one or both of the spouses were not baptized persons during the time of marriage

• A marriage where there was a deficiency in consent or the ability of one or both the spouses
The procedure is the same whether or not there are children in the marriage. If a declaration of nullity is granted then the children are still considered legitimate and retain all legal rights (Canon 1137).
Approach the appropriate person your in your parish who has been trained in the process. If you encounter difficulties, you may go directly to the diocese.

My Fiancee in the philippines has received a granted decision for her annulment from the court of appeals. We are waiting for the court of appeals to release the certificate of finality for her annulment so we can start the K1 visa process. Does anyone know how to get it right away? Answer: certificate can be or cannot be released right away even if told to wait 90days. and the certificate of finality is supposed to be handed from the lawyer that is depending her case/side, so she must approach the lawyer about that as lawyers MUST have their own copies too. too much in a hurry will doubt them also, have it in mind.

Answer: Call a divorce atty; asked if they provide an free initial consultation. Write down all the details in a format that's can be easily read. (That may mean going through several drafts.) Take it with you, hand it to the atty and let them read it. They can read faster than you can talk, and writing it out and going back over what you've written gives you a better chance to include everything and helps in the organization of your statement.
