Answer: No...you signed a contract. The contracted stated that you go to drill and they pay you. You didn't fulfill your end of the agreement. So, why do you think they are going to let you keep your bonus money.

Senate Majority Leader Harry Reid successfully got an $8 billion MagLev high speed train project (from Las Vegas to Disneyland) into the $787 billion Stimulus Bill that just passed. Reid of course is from Nevada. No pork or earmarks in this bill, right?
I'm trying to do the financial analysis on this "investment" project to get a sense of how stimulative it supposedly might be. Your help is appreciated.
Yahoo Maps shows 271 miles from Las Vegas to Los Angeles. A train might travel in more of a straight line (how many houses disrupted? Another good question...), but as an approximation, we can use 271 miles.
So at $8 billion, that's about $29.5 million per mile. Disneyland tickets for 1 day sell for $84 for kids ages 3 to 9 and $94 for ages 10 and over, or let's say $89 on average. So the $8 billion equates to about 89.9 million Disneyland tickets. If open 365 days, that's 246,000 tickets a day, but the park doesn't hold that many. One source shows daily attendance by time of year going from a low of about 11,000 to a high of 70,000. See:

So I'm assuming park capacity at 70,000 and just by eyeballing that graph comparing the red areas of attendance to the white areas of capacity, I'm guestimating the park is about 50% full on average with excess capacity of 50% or 35,000 tickets per day. This is what the MagLev train could try to fill.
So if you've got 89.9 million tickets at $89 on average for each in order to recoup the $8 billion MagLev train investment, with excess daily capacity at 35,000 tickets, it would take 2568 days or 7 years to achieve recoupment on the investment.
But that of course would be just to Disney as if Disney invested the $8 billion itself, and it won't be. American taxpayers will be footing the bill.
Because this train is so heavily going to favor Disneyland (et. al.) as well as whatever Las Vegas casinos, hotels, restaurants, etc., that will be in the vicinity of the MagLev station, I say the AMERICAN PEOPLE should be issued shares of stock in those companies and establishments since we are footing the CAPITAL INVESTMENT to support those businesses.
Or the least these guys can do is issue a free Disneyland ticket to every taxpayer who pays their taxes on time. Jeez Louise! As it stands, this is the crummiest "vacation package" I've ever been forced to invest in!
I don't live in either Las Vegas or L.A. so I'm wondering how my paying for this $8 billion MagLev train is going to benefit me. I need to see what projects in this Stimulus Bill are scheduled for my state but my sense is there are definite "winner states" and "loser states" in this Stimulus Bill and I ask if in the mad dash to write it and get it passed, was there any conscious ANALYSIS of where the money was needed the most to create the most impact for the overall economy? Or might it have something to do with being Speaker of the House (Pelosi) or Senate Majority Leader (Reid)?

Answer: Well, I don't think it can really be built for $8B. It would probably cost more than that just to get the rights of way in place.
The goal is to boost tourism for Las Vegas, not Disneyland. I imagine that the casinos would subsidize the fares for their preferred guests, much like they pay the bus drivers to drop their passengers off for hours at a time.
A MagLev train can travel at up to 200 mph, so it would make for a quick trip to Las Vegas. I rode the MagLev from Pudong to Shanghai a couple of years ago. It was fun and fast.
I don't think anyone has read the entire bill, and certainly those that voted for it did not. It is inconceivable that anyone could given only about nine hours transpired from final printing to the vote on the floor.
I will be dissecting it for my blog over the next several weeks, so stay tuned for updates on the measure. At least now I know what we can argue about since college football's season is over.

Answer: Recoupment cannot be appllied to a witness because it is directed to the defeated party in the case.
Question: army national guard, i want out lol, dont care if its honorable, but i am worried about recoupment? i signed on about a year ago, right after i turned 17, my mom and this recruiter pursuaded me pretty much to join.and ive had 2nd thoughts this whole time and im about to turn 18 so my parents wont really be able to force me to stay in, to keep going to the drills and such, so im thinking about just not showing up to drill a few times untill i get discharged lol.
but this sergeant a while ago was saying that i could get recoupment for money i never even got, and ive been reading other answers about how i could go to jail, get a warrant and stuff.

Answer: The simplest way is to just not show up to MEPS on your shipout date. You will not get arrested so if they threaten it, ignore it. Be sure that this is your final decision before not showing up. Your RSP program will call you asking why you didn't report. Tell them that you changed your mind. If asked if there is anything to resolve it say no. The commanders hands are then tied and they will then process you for separation. Most that walk away want to join again within a year so please be sure that you definitely don't want to join. Something made you want to join. Don't compare the national guard with what you have done in the RSP program. The RSP program is designed to make your life at basic training easier as you know a lot more than the active army members who had no prior training. Regular drills are so much different. Think it through long and hard. Just think: You only have to go to basic once and when it's over, it's over. If you need any help, support, or have more questions, call the GI Rights hotline. I moved and misplaced it, found it last month, and tried to get a reissue. It's only for $460.00, but hey, it's money. Question: Army Reserve Enlistment Bonus Recoupment? I enlisted in the Reserves for six yrs-I only served for one year and received 50% of my enlistment bonus. I then went through the proper procedure to enlist in Active Duty. I am currently active duty and the Reserves component is now going to recoup my bonus, I knew this may happen, but they say I can protest it and possibly not have to pay it back. But I have to find the regulation regarding it, and I can't. Any input would be greatly appreciated,as I don't want to lose 3/4 of my check every month.
I also talked to my career counselor here and Finance. Finance told me that I would not have to pay it back and that the Army had suspended all such recoupments. But the reserves finance has a different story. I do realize ultimately that I violated my original contract
Answer: Contact a Legal Officer on your current base. They can explain everything to you. You can "protest" anything but in the end, you signed a contract and then violated it. You will probably be required to pay back the money.
Question: I was on tour for 3 years, how will interviewers take this? I was in a successful band and toured for 3 years worldwide with them before the major label system ruined us with crazy recoupment fees, and now I have to re-enter the workforce until the licensing comes in. Does anyone know how interviewers of companies take something like being on tour for several years, leaving gaps in your resume?
Answer: It should be alright, at least you have done something these past years, so its not really a "gap" in your resume, just write that you were an artist touring.
You can also use this for your advantage, write/tell them about what you've learned from the touring. Even though its not "work experience", this is still major life experience that has given you important experiences and qualities that could help you in this job
For example:
" This experience has given me an unique insight into different cultures and social situation. This has provided me with excellent people skills..."
" I have toured in many different countries, which has given me an opportunity to practice several different languages, which has left me with excellent communication skills"
Just spin it to your advantage, show them these past years hasnt been a waste, you've learned many important qualities that could be of use in your new job. Of course the relvance might differ from job to job, but you should at least try to show some experience that makes you more suited for the job.
Dont focus on the fact that you havent been working, focus on what the years have taught you.
Question: i took reenlistment bonus to transfer to engineer company, I want to transfer back to medicalwithno recoupment
Answer: I was in a similar situation where I was offered an instructor's position with another unit but had a six-year bonus with an engineering unit.
If you request the transfer, you will lose your bonus, it is specific to that duty position.
However, if you are promoted into another duty position, you get to keep your bonus. I put in for promotion and the unit that had wanted me to transfer got me in a duty position with their unit. I don't know how that end of it works (CSM level), but that is pretty much the only way that I've heard of changing duties without losing (and having to repay) bonuses.

Answer: Hair fall is inevitable after a long disease and treatment with antibiotics. The hair gets normal if there is no hereditary problem. One of the reasons for hair fall is water in your area. Try bathing with bleached (Clorinated) water only and not the water from Borewells.

Question: NROTC Scholarship DOR/Disenrollment? Can someone dumb this down for me? I cannot understand it as presented. Please be specific and clear.

Answer: It kind of depends on how whatever document you are quoting from has defined "recoupment" and "active obligation service" and which "original contract" is being referenced. Recoupment usually means paying back the scholarship funds received through monetary means or through enlisted service. It seems like it is saying that a disenrolled midshipman does not have to pay back the scholarship through monetary means or enlisted service. Inquire at the Nrotc battalion.

Homeowners are financing the states failure to control big business ins companies. Ins companies are making BILLIONS on auto ins, and refusing to take a hit during hurricanes. If Florida told all insurance companies they would:
1) No longer require car owners to carry any form of insurance,
and 2) Tell all insurance companies if they sell auto policies they must sell home policies, these companies would think twice. Right now they laugh at us.
Answer: Exactly, not so amazing is how the people so far have answered, its in their best interest to want US to carry insurance otherwise they cant pay their mortgages.
The facts are if people got off their dead butts and realized the money u paid in insurance could pay for your kids college, or that new boat, or your kids braces, maybe then people wouldn't be so passive when it comes to making the states fight the insurance lobbies and make us the consumers decide whats in our best interest rather than the agents and companies who sell insurance.
Question: 4 tour veteran needs education help.? ok so here it goes. I have served in 2 branches of the military for a combined total of 10 years now. I am currently deployed. When i am at home i attend Ball State University. Now prior to my deployment i had several training excercises as well as the birth of a new child. on top of this i had to move my family to a more suitable location for the extent of my tour. I was forced to withdrawl from school. I didn't have orders until right before i left, but had been gone on excercises for 2 months prior to my official deployment date, so was unable to attend during those times. Now since i didn't have orders yet i supplied a fromal letter from my unit commander (signed and all) to the school to cover the days that werent covered in official orders. Now two of my teachers have shoved F's down my throat. To add insult to injury I was recieving the chapter 30 GI BIll benefits. due to these F's the V.A. claims that i owe them thousands of dollars in recoupment of paid benefits. The school is refusing to accept my withdrawl and they are refusing to help in the matter. According to the schools bylaws it states that students who withdrawl on military orders do not have a deadline and can withdrawl at any time. They choose whether to take a Withdrawl or an incomplete. I have done everything i can and am trying to keep this out of a legal system. I fear that i may not have any other choice in the matter however. If there is anyone out there that has had a similiar experience please help. (and don't simply say go to JAG, or contac the V.A. rep at the school.) i have already done the later to no avail. PLEASE HELP. I have done 4 combat tours including this one. I feel as though i have paid my debts and have earned my benefits. Answer: Assuming this is as you have explained it, I would kick it up a notch and write your congressman. At some point the system has failed to attend to you and while you have tried to meet all their requirements, (letter from commander, copies of orders) they have chosen to ignore your efforts and punish you. Trust me when I say... a letter to your congressional representative will generate some response.

I'm a disabled veteran who has been disabled at 50 percent. The Va takes out 100 dollars a month to match the severance pay that I was awarded when getting out of the service. We'll my rating just went up to 60% and on the letter it says Recoupment of Disability Severance Stopped. It also Notes: It is no longer necessary for us to withhold for your severance pay disabilities because your combined nonseverance disabilities equal 60%. So my question is What does this mean? Will I get the money that they have been taken out back?
Answer: If your upgrade to 60% was retroactive - yes. If it is because your disability has worsened - no.

Answer: To put it bluntly, it sounds like you are screwed.
I commend you for all you do in the military. I am prior service, granted, I only served two years and it was as an Army musician. I know, I get laughed at all the time. With that said, I was also a military spouse for 9 years and went through a deployment. We had to pay for a laptop through the eArmyU program because my ex-husband is a tool, so I can say I have a bit of experience with this kind of thing.
With that said, I wholly believe you are screwed for the following reasons. Deployment is not a free pass nor is it a guaranteed Get Out of Jail Free card nor is it an entitlement to do as you please. From the facts you presented, it simply sounds like you did not follow the school's procedures for withdrawal. Just because you are a soldier does not mean the rest of the world, especially a business of higher education, has to bend over backwards for you. You may feel through your service that they should and that you are entitled, but the reality is, it isn't that way. There are rules and procedures for their "respect" to your service and deployment and if you do not follow those, then you pay the price.
Read their policies top to bottom. Did you follow every step you were supposed to and not ASSUME anything. My ex-husband was an assumer and it cost us a pretty penny. It sounds like you did what he did. You assumed that just because you read somewhere that orders gave you a "W" or an "I", that was all you had to do. It is NEVER that simple. You need to read their withdrawal procedure. Did you 100% fully comply with their withdrawal procedure? You can't just throw orders on them and say, "Peace out." Sorry, it doesn't work that way. My ex-husband found that out. We ended up having to pay for a laptop and 12 credit hours of tuition. You should have communicated with your professors directly. They all have e-mail, phone numbers and mailing addresses. You should have given them a full breakdown of what is happening and ask them what you needed to do to ensure that they assign you a "W" or an "I". You should have spoken or corresponded with the financial aid office, business office, etc so on and so forth.
I am truly sorry that this happened, but it does not sound like, from what you have written, that you have any recourse. They are going to tell you that you are an adult. You should have weighed all of those options before enrolling in classes. Not fair, but they don't care about fair. After attacking why you enrolled in classes with so much on your plate, they are going to attack whether or not you adhered to proper procedures. That means you should have properly communicated with the VA and the school before ASSUMING you were entitled to withdraw. It doesn't appear that way.
From what you presented, I do not feel you are being pushed around. It sounds like there was a procedure in place, you didn't follow it and now you are paying the price. Communication with your professors goes a long way. If you didn't show up and never told them why, they feel no entitlement to leeway.
I could be totally wrong, but from what you've presented, you are going to end up losing this battle.
Question: MY Army Contract, will i get paid? I am in the army national guard, i am set to get the second part of my bonus (10k) in october, i am currently deployed, i vlolunteered to change my mos to 13f and go on a deployment with anoother unit, i was reviewing my contract and it states i will lose my bonus if i voluntarly change my mos to a non critical mos or change units, i would get recoupment from the date of transfer, is there an exception that since i volunteered for a deployment and plan on going back to the old unit and mos when i get back? will i get my full bonus?? thanks
Answer: Nope, you lose your bonus. Your bonus applies to your current primary MOS. Since you will be filling in as another MOS at the time you are supposed to be receiving your bonus you will not be getting it. Sorry.
Question: I am looking for advice on requesting ESY on my sons IEP. He has a PDD-NOS diagnosis.? My son is 7 and is just completing 1st grade. He has had an IEP since kindy. He also has a heart defect which requires PT and OT. I am requesting ESY for this summer. Because of his Aspergers Syndrome he has a difficult time interacting with his peers and difficulty with social skills in general. He has a rule book in school to help him remember the rules and he does get social skills classes in school. The IEP acknowledges that he needs "daily help with social skills training in large group settings" and that he "has a difficult time interacting with his peers." However, they have denied the ESY. Basically siteing no regression or recoupment. They offered my a 1 week summer camp for kids with Aspergers but made it clear it was not ESY..just a sign of "good faith" because they realize he is in need of social skills help. I guess my question is are there state wide criterion for writing an IEP or does it differ by state? We are in Pa. On what grounds can I argue this?
