Question: How long is the wait to receive a decree nisi? The solicitor says he has sent all the paperwork to the courts to apply for the decree nisi ( I am the petitioner). I haven't received anything back yet- it was sent around 5 weeks ago and I'm getting a little anxious. I have two questions really
how long does it normally take to get the decree nisi? and who receives it- me or the solicitor?
I've tried asking the solicitor but now that I've paid up he's conveniently busy everytime I call.

Answer: This may sound sarcastic, it is not meant to.
It takes as long as it takes. The courts work exceedingly slowly at their own pace and dependant on case loads. We may as well ask how long is a piece of string. there are guidelines for how long it should take (I'm not sure specifically what they are though - sorry), but they are only guidelines.
Solicitors are typically evasive when they have nothing else to ear from you but I hope that he has ACTUALLY filed what he says he has that he's not being evasive as he hasn't.
You can also talk to any other partner in the practice to see if he is feeding you a line.

Answer: Did you actually get divorced? A decree nisi does not prove this, it's the decree absolute you need
Question: How can one get a replacement of decree nisi without spending 40 quid? My partner is due to claim his State Pension but has lost his divorce papers, they are bound to ask the date and the silly old fool can not remember. He went to the appropriate place and they said a search would cost him 40 pound, he has been on incapacity since a bad accident in 2000 and has not got that amount to spare. Question: I get my decree nisi this tuesday all the kids stuff was agreed on? But now my soon to be ex as said he wants to get full custody of them but he lives with his mum, in a 2 bedroom house i have a 3 bedroom house the children have schools around the corner family close by. I didn't think you could change the details after they have been agreed on through the courts can my soon to be ex get custody?
I should say i have met a lovely man but i fell pregnant very unplanned will this make a difference. As i will never give up any of my children so all i can say is my soon to be ex is in for a fight (legally)
Answer: Not likely. Since your children are living with you, are established at their current schools, and he doesn't have suitable living area established for the children, it is unlikely that the Judge would change the custody arrangement that you both initially agreed upon.

Answer: Contact the recorders department and request a certified copy. Most of the recorders offices can be contact via the Internet.

Answer: When the court gives you your Decree Nisi you have to wait 6 weeks and 1 day before you can make your divorce final. This is to allow time for anyone who objects to the divorce to tell the court why they object.
After 6 weeks and 1 day you can apply for the "Decree Absolute".
This means your divorce is completed and you are no longer married to your partner.
In judicial separation proceedings you obtain a "Decree of Judicial Separation" instead of the Decree Nisi & Absolute.
You are then legally separated but remain married.

Answer: Where it was filed will give you a copy, or contact his solicitor and get a copy.

I found the reasons why tehy were divorsed, marriage disolved. No decree absolute though, i;ll just ask him
Answer: The decree nisi is applied for first and he then gets a 6 week period where the divorce can be stopped. After that you get a decree 'absolute' which is the final paperwork, this usually arrives separately.
If the paperwork you read doesn't give any reasons for the divorce then it has not been sorted.

Answer: You cannot remarry until you have a decree absolute to give to the registrar
You could make an application to the court backed up by a letter from the registrar for a four week decree, I had to do the same thing and got my absolute 4 days before my re marriage.

Answer: The person who initiated the divorce has to apply for the decree absolute. It is not issued automatically 6 weeks and 1 day after the Decree Nisi. I am afraid that some bitter Petitioners drag out applying for it in order to wield control over the Respondent. If you are the Petitioner apply to the court for it. You can usually get it pretty much immediately. If you are the Respondent you will have to wait for the Petitioner to apply - but if they drag their feet the Respondent can apply for it four and a half months after the 6 weeks and 1 day.

For a fee, they can provide a certified copy of the Decree Absolute or Nisi

Answer: when the decree nisi come through you are still married. The time between decree nisi and decree absolute is supposed to give time to think it through further. Apply to the court if you want the decree absolute stopped. Husband or wife can do this, but obviously you can't keep someone married to you if they want a divorce.
