Question: Can the court change separation agreement? My wife wanted us to separate and to keep the house and buy me out which we did. Since then she has fallen on hard times and most likely has lost her job. She is in severe depression and will probably lose the house we once owned together. I now own my own house and filed for divorce yesterday and trying to move on with my life. Our separation agreement was very specific on what she got and what I got, there were no kids involved so custody is not a problem. My question is this. Can the court change anything in the separation agreement since she may have lost her job and is emotionally unstable?? I am also worried about her not signing the divorce papers.
Answer: Don't worry about her signing the papers for the divorce. Your lawyer needs to contact the court and let them know exactly what is going on. You didn't say, but I assume your name was taken off the home, if not your lawyer needs to deal with these things quickly. Don't fall prey to her illness and try helping her, it just might bring you down also. I do wish you luck. To add, no they can't change anything without both agreeing, this is why you need to talk with your lawyer.

Answer: Usually, in order to collect unemployment, you must be unemployed through no fault of your own. That usually means involuntary termination (firing) or layoff. A separation agreement implies your consent to be terminated, and usually contains financial provisions for you, such as severance pay. Let's assume the termination is not voluntary, but you had an employment agreement and were then not needed. That is a layoff. But if you received 3 months' severance pay, then you must wait three months before you would be eligible for unemployment, because you were paid wages for three months. If your termination was the result of a violation of company policy and you knew the policy, you are not usually eligible for unemployment.

Answer: In Louisiana, you have to be living separately. Check your state law.

My wife and I had separation papers signed back on Sept 13th 2006 and she has been battling depression and has missed lots of work since then. Answer: I'm not sure. I think you may want to talk to a lawyer about this. They would be able to give you legal advice for whatever state you are in about the exact circumstance that has happened.

Answer: There is no such thing as a separation agreement on paper as such, unless you have literally filed for divorce. If your not married well you can't file for that, but nothing other than having contacted a lawyer proves either of you have been living apart - not even the landlord really.
However having said all that, and probably now filled you with doom and gloom - fear not, I still have some advise rolled up my sleeve for you. In fairness you should contact your ex so that you can both sit down and agree what the other one wants.
Get a list typed up of everything, put a tick against things you want specifically, then if she wants that too, put a question mark against that item, move onto the next items. At the end, you'll be left with X amount of things both of you want, so its a case of give and take there done in a fair way. You choose one thing, she lets it go, then she gets first choice at the next marked ? item.
Try and do it this way, keep things as amicable as you can, and don't throw the list away - both of you sign it. That way if it turned nasty and she took you too court, its there in black and white what you both agreed to keep.

Answer: I think there is a term called "discovery" which means that spouses must divulge all assets. Otherwise, it may be deemed contempt of court or possibly perjury.

Answer: In my state there is no such thing as a separation agreement. Look at your agreement, it should give you the guidelines. I don't see how a separation agreement can be "voided".

People often get legal separation and divorce confused, because most of the time people file for divorce.
Separation = Separation of all assets and liabilities. (all property, retirement, wages to include bonus's etc.) It also spells out, child custody, etc., which is always open for modification. Once the separation is approved you or the spouse have no claim, or responsibility to each other anymore.
A separation DISOLVES the marriage license. Your lawyer should have spelled that out for you.
Divorce = Approval to re-marry.

Answer: process use already running services. A service can serve multiple processes. Process is unitary, a process starts when you take an action, i.e. open a browser, start up word or excel and closes when quit the program, close browser etc. or be done with your action while any services it utilized will continue to run. A service starts when you start up your system and is always running (Unless you manually shut it down from control panel).

Question: Navy Enlistment Process (Prior-Service and USN experts please)? This question is going to be a little bit long, but bear with me because I'm completely confused.
I've been with a Navy recruiter for a few weeks now. This week on Wednesday I went down to the MEPs and completed my ASVAB (Scored a 78) and medical (passed), but had to have an immediate consultation which set me back about 2 hours from the rest of the guys I was processing with that day. By the time I got back, finished medical, and got to the liaison office, there were a lot of people waiting to speak to the classifier.
I got my blueprint out of the way, and waited another 2 hours before I was informed that no jobs were left available that day, and I would have to return to the MEPs another day to get fingerprinted, contracted, and sworn in. My recruiter told me that we would come back on Monday, and if not Monday, Tuesday for sure. We returned to the office and I left. The next day, I got a call and was informed that Monday was definitely not going to happen, and neither would Tuesday. I was told that the earliest they could get me in was January 1st (WTF?!). I asked why, and was told that "the Navy is not hiring right now, but just be glad you're this far in the process." Yeah, I know the Navy is seriously overmanned, but of the guys that processed through the MEPs with me on Wednesday, two of them who I talked to had no trouble making the rate I wanted (AD), and will be shipping in February. February is awesome, compared to the *LONG* wait times most DEPpers had to endure up until now. Ship times in February doesn't really tell me that the Navy is overmanned anymore.
So anyway, I wrote to my recruiter and was told that after speaking to the Chief, I would be able to come into the office on Monday and get into the DEP and complete my 72-hour indoctrination. It just seems kind of weird to me that I would be getting into DEP without a contract or ship date yet. Can anyone clarify what this means and how it will benefit me before getting a contract? My recruiter would not give me any more info until I sit down with him on Monday. He seemed to be in a hurry and hung up before I could finish asking questions.
Also, will finishing my MEPs process a month later have a dramatic effect on when I'm going to ship? I really, really want to ship in February or March, and since I could have enlisted on Wednesday and would have been scheduled to ship in February, I'll be pretty bummed if I get say...May or June instead because I was 1 month late.
Can anyone clarify what's going on here, and why my contract and initial swearing in have been delayed so long. Am I just being d*cked around, or what? I've had problems communicating with my recruiter before, where I was scheduled to leave for MEPs on December 7th, and then suddenly was called last Monday and told I was scheduled to go to the MEPs the next day. Wtf is going on? I like my recruiter, he's very professional and he's a nice guy, but is there something I'm not seeing here?
Edit: You could be right, but the two others who got AD rate on Wednesday had lower ASVAB scores than I got. I also have some college credits, clean record, 4 years JROTC, and a desire to get the hell to basic ASAP.
Answer: Basicly what is happening to you, as well as thousands of others is known as "QNJ" (Qualified No Job(s)).
As to the two that got AD on the day you did not, it could well be that they were more qualified than you and just happened to be there at the right time when the two AD slots opened up.
