Collaborative Law
An alternative way to settle disputes in which both parties hire specially trained attorneys who work to help them respectfully resolve the conflict outside of court. The participants agree to work together to seek a solution that works for both parties. If the dispute can’t be resolved through the collaborative process, or if one of the parties threatens to go to court, then the collaborative law process ends and neither lawyer can continue to work on the case. Question: How does collaborative law differ from mediation or litigation?
Answer: In collaborative law, both parties hire collaborative divorce lawyers and sign a contract with them, in which they agree to resolve their divorce without resorting to litigation. Instead of fighting it out and trying to "win" over each other, the spouses and their divorce attorneys negotiate with each other in private meetings in order to reach a mutually agreeable settlement. If the process doesn't work, then both collaborative lawyers must resign from the case and the parties have to hire new family-law attorneys to resolve their divorce in court.
Like mediation, collaborative family law is a cooperative, cost-effective, and stress-reducing alternative to litigation. But the main difference between collaborative family law and divorce mediation is that, in the latter, the spouses work out their settlement by themselves under the supervision of a mediator. Although it's recommended that each mediating party retain a lawyer to advise them, divorce attorneys generally don't attend mediation conferences; instead, a lawyer drafts the final settlement papers, and the parties' own family lawyers appear in court to finalize the outcome. Another key difference is that the collaborative-law process specifically prohibits litigation.
One unique feature of collaborative divorce is the frequent use of neutral professionals -- such as a financial advisor, divorce coach, or custody evaluator -- to deal with both parties' financial, emotional, or custody/visitation issues. In litigation and mediation, the parties might choose to hire their own professionals to help with these issues on their own sides. But in collaborative family law, these professionals are unbiased and work together with both collaborative family-law attorneys.
Collaborative law is a unique new process that aims to bypass the traditional adversarial divorce -- while constantly employing legal expertise -- through a spirit of cooperation and a mutual agreement not to resort to court.

Question: What are my rights as a mother and primary caregiver of our child? My husband and I are about to start our collaborative law sessions in effort to come up with a legal separation agreement.
He left us about 4 months ago, the baby is almost 7 months old now. He announced the other day that he is seeing someone else for the last month and a half.. It has really been hard to get the truth out of him about anything lately, and I have asked him if the new girlfriend has been spending time with him and the baby when he has her. He said no, but I really don't beleive him. The place that he was living was kind of a construction zone (a firend of his owns the house, but lives somewhere else, there are constant renovations going on, and I know he was unhappy staying there). I am assuming he is spend his overnights with the baby at his girlfriends place, but he won't admit to that. Do I have a right to know where my baby os staying when she is with her father, or is the only thing that matters is that she is taken care of. It just feels weird to me that I don't know the answer to the question, where does the baby stay when she is with her father??
Answer: Although you do not have legal rights to tell him who he can and can not have the baby around, you are RIGHT to be concerned.. It takes time for a "step parent" to bond with a child and learn to love it. And not everyone will love your child, but hopefully her Daddy is wise enough and loving enough to only let her associate with good decent people.
You should know where your child is when it's away from you, he should have nothing to hide. What if there is an emergency situation with her Daddy, one where you would need to get to your daughter--how you going to do that if won't even tell you where they stay? I don't think there is anything you can do, as long as your daughter is well cared for. Best wishes, Your situation sounds really difficult...

With the media now reporting on the late senator's just released Federal Bureau of Investigation (FBI) file, now is an opportune time for a more expansive investigation into Kennedy's KGB contacts. The agency took a keen interest in a 1961 "fact-finding" trip the Massachusetts Democrat took to Mexico and other parts of Latin America where he may have had contact with communist agents, according to the file.
However, the 2,352 pages of FBI files that cover a period ranging from 1961 to 1985 only tell a small part of the story and do not mention Kennedy's overtures to Soviet officials. These did not become known outside of Moscow until several years after Cold War tensions receded.
Kennedy's long history with the KGB is well documented, but underreported. STATESBORO, GEORGIA - A father was seriously injured and his son was killed Tuesday when a rental trailer they were towing was rear-ended on Interstate 16 by a police officer who specializes in nabbing aggressive drivers and who was en route to Chatham County to take part in a safe-driving campaign, officials said.
Cpl. Robert Balkcom, an assistant commander of the Georgia State Patrol post in Statesboro, said no charges have been filed yet, but they are likely, against Dougherty County Police Officer Jeremiah Fenn, 25, of Albany.
Officer Fenn was headed to Chatham County to take part in Operation Rolling Thunder, a 90-day effort to curb Savannah’s rising traffic fatality rate with the help of scores of officers from around the state.
Officer Fenn was driving eastbound near Metter when he took his eyes off the road for a second to look at the computer mounted in his car and struck a trailer being towed by an SUV traveling in the same direction and in the same lane, Cpl. Balkcom said.
The video camera in Officer Fenn’s car, which could have recorded the accident, was turned off, Cpl. Balkcom said.
The SUV overturned several times, ejecting Milton Wilcox, 33, of Savannah, a passenger who was not wearing a seat belt, police said.
Mr. Wilcox was pronounced dead at the scene. His father, William Wilcox, 57, of Savannah, the driver, was airlifted to Savannah’s Memorial Health University Medical Center with serious injuries, Cpl. Balkcom said.
A two-mile eastbound stretch of the interstate was closed for about six hours while members of the Georgia State Patrol’s Specialized Collision Reconstruction Team investigated the accident, Cpl. Balkcom said.
Witnesses told authorities that Officer Fenn’s police car was “traveling at a high rate of speed,” an issue that will be addressed by the investigation, Cpl. Balkcom said.
“There will more than likely be charges,” he said.
Officer Fenn is a participant in a statewide program known as Highway Enforcement of Aggressive Traffic (H.E.A.T.), a collaborative effort of the Governor’s Office of Highway Safety and eight local law enforcement agencies to nab aggressive drivers.

The Department of Education believes that all of these schools are failing schools and that the students there are not obtaining the education that they deserve.
The other view is that the schools are doing the best that they can, the statistics are inaccurate, that the city has not given the schools the resources needed to improve education, that little or no help or supervision has been provided by the Department, that the Department of Education does not listen to the feedback that it receives, and once a school is rated poorly many students do not enroll or actually change schools thus leaving mostly the poorer students there with a result of not being able to raise the school statistics.
In general when attempts were made last year to close some the schools that were already on the list students, parents, and teachers were opposed to the closings.
Answer: I am a NYC public school teacher at the elementary level. My children go to NYC public schools, though none of the ones in question. I have no affiliation whatsoever with any of the above schools.
I have a few concerns about this plan:
1) Klein and Bloomberg have a plan to replace large comprehensive, high schools with smaller, more specialized schools. While I basically applaud this idea, it has been carried out in a ham fisted manner. They have not put enough small schools into place for the number of kids they have displaced by closing the schools that they have already closed.
2) The schools they initially closed in the past few years may or may not have been irretrievably awful, but by closing them without sufficient replacements, they have shunted those kids (many of whom are low performing students - the hardest to teach kids) off onto the other comprehensive schools, making THEM dysfunctional. Many of the schools they now aim to close (like Christopher Columbus High) were performing fairly well, till they got overwhelmed with the displaced kids from other closed schools. The DOE did not give them any support for all these new low performing students! And now, THESE schools are suffering the consequences of Klein's (and, by extension Bloomberg's) actions. (And I can't imagine that there will by much more help for other comprehensive schools that will take the extra kids caused by the closing of these schools, what with the current budget cuts in education. I have no faith whatsoever in this program of so called "turn around schools". That's just a way of putting the entire onus on teachers to turn the schools around with no help from the DOE!
3) While large comprehensive schools may not be good for everyone, and while the DOE has created some interesting new, smaller schools recently, there really is a place for well run, comprehensive high schools. Some kids really want to go to a big school, with all the activities that kind of school provides - sports teams, theater, orchestra, etc, etc. And there are certain special services that can only be provided by larger schools - Robeson had a program for teenaged mothers, the only one in the Borough of Brooklyn. That's the kind of program that might be essential to help a teen who is floundering to complete a high school education.
4) Bloomberg and Klein TRIED to close these very same schools this past year and were prevented from doing so by a judge! So how come the same list of schools is now in the news again, slated for closure???? What gives?

Jim Kenna, state director of the Bureau of Land Management in Arizona, was the guest last week on Live Talk. Kenna oversees the management of BLM Arizona's 12.2 million surface acres of public lands and is responsible for about 600 employees in nine offices. He began his career about 38 years ago in Arizona as a wildland firefighter. He has a B.A. in economics from Prescott College.
1. What has been the impact of your joint operation to better secure key BLM lands in Arizona affected by drug runners and illegal immigration? The operation is directed at three primary goals: public safety, protection of public resources, and cooperation on border issues. We have enhanced safety of the visiting public and employees working in the area by increasing law-enforcement presence. We have increased trash cleanup and restoration of lands affected by smugglers of immigrants and drugs. And we have heightened cooperation and joint operations with partner law-enforcement agencies, including with the Border Patrol and county sheriffs. This cooperation extends to sharing mapping, communications and intelligence. 2. What prompted this effort? How long will it run? Increased collaborative actions around public-safety issues began in 2009, followed by BLM engagement with the Alliance to Combat Transnational Threats in early 2010. Events in 2010 also contributed, such as the Pinal County sheriff officer shooting and double homicide in the Vekol Valley. We anticipate increased cooperation, law enforcement and on-the-ground restoration efforts to continue as long as necessary. 3. Which agencies are you working with? How many people are involved? Cost? We work with ACTT, a multiagency operation in the Sonora-Arizona corridor involving over 50 federal, tribal, state, county and local law-enforcement and public-safety organizations. Additionally, we work with the U.S. Attorney's Office and the county attorneys. Numerous employees are engaged in various portions of the operation, covering law enforcement, prosecution, trash cleanups and barrier construction. Law-enforcement, construction and cleanup costs are estimated at $400,000. 4. Is it possible this operation will serve as a model for the BLM in other states? We believe this model can be used, not only by the BLM, but also by other land-management agencies. No one agency or organization can resolve complex border-security problems as effectively as a coalition that shares interests in protecting public safety and public land.

do at a community or group level. Victim service
organizations are often hesitant to focus on crime
prevention because they are usually focused exclusively on
the aftermath of crime. However, victim service
organizations, especially those working on domestic
violence and stalking, often assist individual victims with
"safety planning" to develop strategies to maximize the
victim's safety. Collaborative efforts using both these
approaches could prove to be very effective.
In summary, our overall project has reinforced for us the
importance of closer collaboration between crime victims,
crime victim organizations, and the police. It is time to bring
the victim into community policing.
Our work shows that community policing can be greatly
enhanced by working to prevent repeat victimization and
building collaborative problem solving relationships with
victims and victim organizations. The information and tools
included in this package are a distillation of all that we have
learned over the last 18 months about the relationship
between police and crime victims. We hope that these
materials will help police organizations enhance the practice
of community policing by building stronger problem solving
relationships with crime victims and the organizations that
serve them.The Promise of Preventing Repeat Victimization
A fundamental tenet of community policing holds that police
should work with community-based partners to solve
problems. The most difficult aspect of problem solving is the
identification and effective analysis of problems. Police
organizations use an array of macro-level tactics to identify
and analyze crime problems. Data are collected, crime maps
are analyzed, patrol officers are surveyed, and community
organizations are consulted. This approach depends on a high
level of resources and tends to only identify problems once
they have become big enough to draw police attention.
In contrast, identifying and preventing repeat victimization is
problem solving that starts at the micro level. Because repeat
victimization affects individual people and targets, effective
problem solving begins at an individual level and moves to
larger groups when appropriate.
To fully understand the nature of repeat victimization and
develop effective responses, law enforcement agencies must
capitalize on non-traditional as well as traditional sources of
information. It's essential, for example, to look beyond arrest
data and calls for service and consider residential, business
and environmental surveys, victim and offender interviews,
mapping/GIS data, and social services data. The next task is
to analyze this data.
Thorough data analysis can yield surprising information about
underlying causes, illuminating problems and pointing the way
to solutions. Only through sound analysis can the detailed
picture needed to fashion effective responses emerge. Without

Answer: I think that u are mistaking the two ...definitely both have same goal of studying the human mind and behavior..but psychologists focus more on observing the behaviour and try to connect it to some long or short time experience of the patient and only solution they give is to avoid that situation or doing just the opposite.while psychiatrist after getting the problem give the solution practically applicable.
