The right of the state to take charge of the care and custody of minor children or other legal incompetents when their health or safety so requires.
Question: Palimoney for those living together? If you've been living with someone for 12 years, and the other person decides to go, do you get half of their money? He said that he would give me half but now, he seems to have changed his mind. Also, can I file for some sort of palimony?
This is for someone else...........
Answer: It depends on the state and the circumstances. If they gave up their job and the other person took care of them like a spouse then there is a good chance of it happening.

I live in New York and although they do not believe in common law marriages I was wondering if I would be entitled to palimony?I have been with boyfriend for almost 19 years living together for all of them.He owns houses, cars, etc, my name is on nothing(i'm a fool) we share 1 yr old twins together(child support I no I can get), the problem he has financially took care of me all these years. The relationship is now coming to an end and here I am with 2 kids and basically nothing. He refuses to even help me get into an apartment and is being very selfish.I just want to no is there a way to make him more financially responsible?Am I entitled to palimony?
Answer: Palimony is generally only available when there is a written agreement. You will be entitled to child support, without a legal marriage (NY does not recognize common law marriages) you are not entitled to any other kind of domestic support.
Question: Cold case murder suicide mystery involving indie folk punk rocker Elliott Smith, and his girlfriend? http://www.thesmokinggun.com/archive/esmithaut1.html
Her name is Jennifer Chiba. She claimed in october of 2003 that she had an argument with her then boyfriend Elliott Smith. She claimed she locked herself in the bathroom of their house, and then heard him screaming. When she opened the door she found a 8 inch kitchen knife sticking out of his chest. She pulled out the knife and called 911. He died 78 minutes later.
The problem with this is that Elliott Smith had cuts on his palms and his side to indicate defense wounds. He also had apparently stabbed himself in the chest two times without the normal hesitation that is common in a suicide. Jennifer Chiba was not ruled out as a suspect, and it was never declared a suicide by coroners. She also hired a lawyer back in october of 2003 when it happened who instructed her to shut up. A year later she tried to sue Elliott Smith's family for a million dollars seeking palimony money from his estate. She also had admitted arguing with Elliott right before that incident happened. She said she locked herself in the bathroom, then heard him scream, and found the knife in his chest and pulled it out.
To be fair, Elliott Smith had a history of depression, and tried to commit suicide back in 1997. I am having trouble buying all of Jennifer Chiba's story though. He apparently stabbed himself twice in the heart with his shirt on. He was found to have no illegal drugs or alcohol in his system.
Jennifer Chiba went to his studio two nights later and took some of his recordings. She also battled his family for his money claiming palimony, and she was his manager. I really hate to point a finger at someone I don't know, but this story really seems fishy. There were no hesitant wounds that are usual on a suicide. Also, on his small suicide note he misspelled his name. He wrote Elliot, instead of Elliott.
Jennifer Chiba refused to talk to detectives after hiring a lawyer. I am just wondering since it was never officially called a suicide or murder, if it is a cold case that can be reopened.
I don't like opening old wounds but I'm a big fan of Elliot Smiths music. I've included a song by him. Please read the smoking guns coroner report, and let me know what you think.

Answer: I've always found this story far more interesting than the Kurt Cobain / Courtney Love controversy. Possible because it's been played out to death.
If anybody has ever wanted to die, it was Elliott Smith. Yet NO ONE wants to die so bad that they're able to not hesitate in stabbing themselves multiple times, without any drugs in their systems.
I could never understand why his death wasn't more thoroughly investigated. But hey, who knows except her?
Question: Why do some men here feel that only a wife can take half of your assets? A recent case allowed a mistress to collect palimony They never lived together), also do not forget common law marriage. If it is really a big concern, then you better dump your girlfriend before 12 months.

We hold that cohabitation is not an essential requirement for a cause of action for palimony, but a marital-type relationship is required," wrote Justice John Wallace Jr. in Devaney v. L'Esperance, A-20-07.
I never stated I support what the guy did, but it is an example.
Answer: Lets not forget the wife whether by common law or maritial status can not only take your money but your mistresses money as well. Have you heard of Alienation of Affection?
Question: How do you sue the man you Mom was married to but now only lives with? My mom and her husband are divorced but hav been living together since about 13years. She has bad credit and he said he would help her buy a new car. She put the down payment on the car and was paying for it before she lost her job. He put the car in his name and told her he did not add her name cause she had bad credit. Now he drives it and pays for it and told her it is no longer her car. He gave his car to my brother. He did this once before when they were married. Now she is left with nothing but a relationship she feels she can't get out off cause he took everything. I heard about a palimony law in Florida. How can I help her?
Answer: palimony suits take years to settle and are difficult to prove.
besides, how long did your mom lost her job? if its more than 3 months, then it goes to figure that would be the time that she wouldnt had paid the car and it would had been repossessed. the car is in his name, she is up the creek. you cant have it both ways. if they did it to keep the payments low due to his good credit that was the chance she took with someone that hadnt her complete trust.
Question: Was I unfair to my wife? Before we got married we had a pre-nuptial agreement that states we each walk with what we have in our personal names, and split everything down the middle that we own jointly and our incomes remain our own, no palimony and no alimony. I convinced her that the pre-nup was in her intrests because she made four times as much as I did before marriage, but I knew my career would yield much more. was I unfair?
She is a PharmD and makes about 120K a year, I was a stuggling writer but my royalty checks far exceed her income now, and I have been buying things in my own name for over 15 years. We only on the house together, all rental properies are in a family trust
I stick out my tongue to the "Spurs fan"
Neener neener...
Jenn, the unfair part is that her Dad is a publisher.....
Answer: If she signed the pre-nup then she knew the parameters.
Why are you feeling guilty now?
