Third Party Liability
The responsibility that an entity, other than the parties to an action (CP and NCP, usually the parents), has to the State provider of health care coverage for reimbursement.
Question: Consequence of filing a third party liability claim? My friend is the driver at fault in a automobile accident and I was a passenger of my friend's car. She has $1 million third party liability coverage with TD insurance. If I claim third party liability with her insurer to cover my injuries and pain and suffering, will there be any consequences for suing her? Or will be all be covered by her insurance coverage?
Answer: Having been the driver in that scenario I can tell you that her insurance rates are going to sky rocket. Mine literally tripled for 3 years. As long as you do not sue her for more than her policy limits nothing more will be done to her.
Question: Is there a difference between public and third party liability insurance? Public Liability Insurance and Third Party Liability Insurance appear to be used interchangably in many Contract documents. Are they the same?
Answer: Yes, Public Liability is the same as Third Party Liability. Just another way of expressing the same cover (in the same way that Car Insurance is the same as Motor Insurance).
Public liability covers you for third party injury or property damage and that is probably why some people refer to it as third party liability.
Question: Will Insurance Compny Cover third party liability for my freind who was charged &fined for negligent driving? My friend pleaded guilty for rash and negligent drving in India, as per police investigation. My friend has valid driving license, policy etc. Now there is a third-party claims for damages in the same accident which insurance company lawyer is defending on behalf of my friend. They have taken the defense that the accident was solely due to the fault of other vehicle's unlisenced driver. Is it OK to take such a defense in MACT claim even through he pleaded guilty in criminal offense.
Answer: This is a tricky one. Your friend had pleaded guilty, so most likely in MACT his negligence would be considered, unless there is a substantial evidence on the fault of other driver, in this case defense might work as other vehicles driver does not have effective driving licence. Many times such cases fall under contributory negligence. Also to remember, criminal court judgements are not binding on civil or MACT.
You need to find the details in the police report (most of the time police would blame it on the bigger vehicle) how the collision has happened. If it is head-on generally speaking insurance company would consider it as a contributory.
Even if the negligence of your friend is proved in MACT court because he pleaded guilty, insurance company is bound to honour the policy and pay the compensation awarded. If insurance company has admitted the policy and there are no violation of policy (driver must have effective licence, vehicle use not for hire and reward or commercial purpose if it is a private vehicle) then your friend is 100 percent safe.
You might want to get a certified copy of written-statement of your friend and insurance company. You may need your own lawyer for this as insurance layer will not co-operate with the insured.
Question: How to apply Third Party liability insurance on a car rental from a company like Hertz, when renting overseas? Many credit cards cover CDW & Theft, but not 3rd party when you use them to reserve & rent a car. Hertz doesn't offer 3rd party by itself when renting in Spain, is it already included?
Answer: No it is not included/
Question: What's the difference between comprehensive and third party liability insurance?
Answer: That other answer is incorrect.
Comprehensive coverage usually covers non-collision type of damage. For example, you hit a deer, or a light pole falls on your car while its parked etc.
Now the other part: If you cause an accident, then the other party has the right to collect on damages. So your LIABILITY insurance is inplace to cover the other driver. Usually there are three numbers to your liability limit: example: 100/300/100, the first number means that there is $100k available for each of the injured parties' bodily injury. The second number means that there is a total of $300k available for all bodily injury claims for that one incident. The third number means that there is $100k available to take care of the other vehicle's property damage.
I hope I didn't make it too confusing. Let me know if you would like clarification.
Question: is there such a thing as third party liability regarding animals? If an owner gives a dog to the humane society (because the owner doesn't want it anymore) without telling them that he bit a person/animal, and after the dog gets adopted, he bites again, can the humane society hold the previous owner responsible?
Answer: If you or someone you know is considering surrendering a dog to a shelter & there is a previous history of biting, it is in the dogs best interest to volunteer that information. Many humane societies will do resocialization training with the dog, & it also helps them to place the dog in a suitable home, so that they don't wind up being re-surrendered.
However, if a dog is surrendered & information is not provided, I do not believe the humane society can hold the person liable. It is possible that future owners might, with the way law suits work in our world today =-( But there is a risk with any animal at a shelter, given that they take in strays as well. Also, not every shelter is as thorough with gathering the history of a surrendered animal.
So in short, the best reason to give the information is for the good of the dog. If you are worried about the dog being put down for aggression, you can contact no-kill shelters instead, where the dog will be rehabilitated & rehomed, instead of judged based on it's adoptability factor.
Question: what's the difference between comprehensive and third party liability insurance?
Answer: Thrid Party Insurance indemnifies vehicle owners and drivers who are legally liable for personal injury to any other road user in the event of a motor vehicle accident. Your TPI insurance will cover you for personal injury claims made against you by other road users such as drivers, passengers, pedestrians, cyclists, motorcyclists and pillion passengers.
It is a compulsory form of insurance and the TPI premium is included in your registration payment.
Comprehensive Car Insurance not only covers your car for accidental damage, theft and fire. But also gives you $$$ liability cover for damage you may cause to someone else’s car or property.
In Australia TPI is compulsory and all vehicles must have this form of insurance (ATLEAST)
Its better to get fully comprehensive but it is very expensive.
I hope that answers your question. :D

Question: About third party liability insurance law in Egypt? Hi, I hit someone by car in Egypt, just minor injuries, however, he claims companisation and win the case by court, the insurance company was envolved in the case too as an insurer (third party liability obligatory insurance). now shall i pay the whole claim amount? or the insurance company should pay automatically? or i should claim the insrance company first to force her to pay or what? I need to know the laws cause i dont recall what was written in that insurance policy as we here consider this as a routine paprers and dont look at it. thank you
Answer: Ouch! Sorry to read you are in such trouble. OK wel lthe bad newsis if you hit someone in Egypt with your car ..and eithere one admit it or got a ticket for it and there were witnessesor if you have gone ot court and lost.....then I regret to inform you that yes you OWE. Make sure you get the injured party to sign a legal statement indicating they are fine now and have been cleared by a doctor...date ti and put it in an envelope and mailit to your self. This is for your own protection ..never opne this letter unless you get dragged inot court with this other party claiming months later that YOU INJURED THEM AND THEY WANT EVEN MORE COMPENSATION! Having this letter covers you. Now as for your insurance company they may or may not be required to restore any funds you pay out ...it depends on what kind of coverage that you elected to take out with them ...and if it was a rental car you were using there and I assume it was and you failed to get the insurance that they offer then your car insurance may not be obligated to cover you in a country outside of the USA. EVERY POLICY has different clauses ...and ti is up to you to elect to add these ..most Americans do not have this coverage though.
Soyea ...you must pay the whole claim amount unless you appeal it to a higher court..consult your lawyer about this process as it is not the same everywhere. As for the laws well they should be available at your local Embassy.
Good luck and buckle up(oh and no more cell while you're driving)
Question: Co-operative car insurance - third party liability? i am 17 years old. I have a fully comprehensive car insurance policy with the Co-operative insurance. i am a named driver on this policy but would like to be able to drive my parents cars. What i am wondering is, is it possible to change something on my policy so as to get third party liability on their cars, as i would not use them enough to warrent adding myself to their policys.
Answer: You need to see this BBC news link about fraudulent car insurance fronting as it sounds like you are a named driver on your insurance when you should be a main driver http://news.bbc.co.uk/1/hi/programmes/mo…
As you your question - if you are a main driver with comprehensive insurance you are often covered to drive cars that do not belong to you on a third part basis with the owners permission and with said car insured by the owner as well. The policy schedule and document will tell you this. Policyholders under 25 are usually not given this privilege as the insurers know that they may end up driving cars much higher in power and value than what they have insured themselves. Anyone who is not a Main driver AND Policyholder is never afforded this cover ever.
Question: Third party liability? I was injured in a car accident caused by another person, and my insurance covered the bills for my treatment. My insurance includes a clause for third party liability stating that they have the right to be reimbursed for my medical treatment if an accident or injury was caused by a third party. Does this mean the person that caused the accident has to reimburse them or that I have to sign my insurance settlement over to them once I receive it?
Answer: When you receive your settlement check you have to send a check for the amount they are owed under the term of the policy.
Question: Auto Insurance - third party liability? If I have third party liability ONLY on my auto insurance and I got into an accident and it was my fault, I understand that the liability does NOT cover my car. But does it cover MY bodily injuries?
Answer: No, 3rd party liability is only for other people.
If you're asking about actual medical bills, check your policy's dec sheet for either "Med Pay" or "PIP - Personal Injury Protection" (they're not required in all states); if you have either, that's what would cover your own medical bills due to injury, regardless of fault. That's bills only, not pain and suffering, which you wouldn't be owed since you're at fault.
Hope this helps. Good luck.

Question: Third Party Liability? Is it a good idea to allow third parties to be sue for damages? Say for example, suing McDonald's for a heart attack caused by eating too much fast food or suing a gun manufacturer for a shooting death.
Answer: Well I don't know about suing in your above scenarios because suing McDonalds for getting fat is stupid, and usually you can't win a case suing on a respondeat superior basis when there is an intentional crime like a shooting. But if it was an accident based on a faulty product or an unsafe design, like not having a good safety, then yes, it is a good idea because big companies have a duty and obligation to make safe products. Often times, when people are injured at no fault of their own, and the person who directly caused the harm has no money, people will try and sue the person with the deeper pockets. Although there might not be a viable case in the above situations, it is important because people need to be made whole again when they're injured. Big companies are held to even a higher standard because they make money off their products so if someone is hurt as a result of their product, then they can be named as a defendant.

Question: Third party disputing liability for car accident? Car smashed into the back of me when i stopped due to a parked car ( driver ) opening her door . There were 2 cars travelling in the opposite direction and as cars parked on both sides of the road i had to stop. I did not emergency stop however and the third party had time to react but i feel he was not paying attention. He admitted liability at the scene but asked me not to go through insurance. However i had to and they are now disputing liability and i have to write a detailed description and diagram to send to my insurers. I have legal cover so do you think i have anything to worry about?
Answer: it is standard to get reports from both drivers in an accident.
he should be found liable for failure to pay attention and following too closely. but if his company fails to pay, then suggest you have your insurance company handle if you have collision coverage and they will go after the other guys insurance for reimbursement.
good luck
