Question: Decree Absolute??? Hi,
Can please anyone help.
I got divorced last year. At the moment am in abroad and I wanna get marry here but thing is the court here not approving my decree absolute. They saying the decree must have a signed by a judge, but my decree only have a county court stamp.
Can please anyone let me know whether UK decree absolute need to be sign by Judge or stamp is sufficient.

Answer: It must be both stamped by the court and signed by the judge, a solicitor cannot sign in lieu of a judge, they simply don't have that authority.

Answer: The copy of mine took about 10 days, so it could be close.

Answer: Assuming no reconciliation, the decree nisi can become absolut exactly six weeks after the court granted it. You would be free in law to marry after the six weeks from decree nisi, then.

My father recently passed away and I am currently sorting through his estate. My mother and father got a divorce some years ago and I have only just now seen the Decree Absolute.
The problem is that I have noticed that my mother's name is spelt incorrectly on the Decree Absolute. It reads 'Ceclia' instead of 'Celia'.
Therefore Is the decree absolute valid as the original marriage date is correct and her name looks similar, or might this be a problem?
Answer: Yes, as a rule, minor typographical errors will not negate things such as this.
Question: How do I get copies of marriage cert & decree absolute when I'm not certain of the dates? My marriage was in 1983 in Lewisham, London and my decree absolute was granted sometime around 1986-88. As it was sometime ago, and a time I wished to forget I haven't thought about it for a long time. Can anyone help with info on getting copies of both?
Answer: Don't know how it is in your country, but here in the states a call to the court house in the "county" where the decree was issued, a phone call is sufficient. Marriage & divorce are public records. You could just give them a call & get the info you need on the phone. IF you need copies of anything, MAKE SURE you request you want the original copies, here we just mail the ck. with a self addressed envelope & they'll send you the info you need. I don't foresee you having any problems with it tho. So I'd start there, if you need more info, they will advise you...the best to you...:)

Answer: You have to apply for it, both of you and individually. Then any signing you have to do you do then. You dont have to do anything together anymore.

Answer: Depends on if any new evidence is entered.
A decree nisi (from the Latin nisi, meaning "unless") is a court order that does not have any force until such time that a particular condition is met, such as a subsequent petition to the court or the passage of a specified period of time.[1]
Once the condition is met, the ruling becomes decree absolute and is binding. Typically, the condition is that no new evidence or further petitions with a bearing on the case are introduced to the court. The wording of such a decree is generally in the form of "that the marriage, had and solemnized on (date) between AB and CD, be dissolved by reason that (grounds) UNLESS sufficient cause be shown to the court why this decree should not be made absolute within six months of the making hereof". This allows time for any party who objects to the divorce to come forward with those objections. It is also at times termed as rule nisi.[citation needed]
In most common law jurisdictions, a decree nisi must be obtained in possession proceedings before the court will order foreclosure under a mortgage enforcement.
This form of ruling has become a rarity in recent times, with one exception: in some jurisdictions it is still a standard stage of divorce proceedings. In England and Wales, section 1(5) of the Matrimonial Causes Act 1973[2] provides that "Every decree of divorce shall in the first instance be a decree nisi and shall not be made absolute before the expiration of six months from its grant", and section 9(1) allows any person (including the Queen's Proctor), before the decree is made absolute, to "show cause why the decree should not be made absolute by reason of material facts not having been brought before the court".

Answer: You'e two options. If you know the name of the court who granted the decree then you go there and apply that way through the clerk of the court, or else you can apply centrally from the main family division of the High Court in London and apply for a search from the Decree Absolute section there. Their number is 020 7947 7017, but searches and certified copies aren't cheap. I think I paid about £30.

Answer: Phone them and ask. From what I can remember I had to send the original absolute. I made sure that I kept a copy at home, but they did send it back.

Answer: Yes you can. When you register your 'intent to marry' you will need to have the original death certificate of your ex husband.

Answer: Its a case of "if i cant have you then nobody can". You need to decide how you feel, if you dump this nice guy and go back to your cheating hubby, what guarantees do you have he wont do it again as soon as he gets bored, or if something better does not come along? Personally, i think you got rid of a dead lump, he never gave you a second thought when he left you and your children. Tell your ex hubby that you no longer love him, that you will never trust him. He has every right to see his kids. Concentrate on your new lovely guy, and think how he must be feeling knowing your cheating dirty ex is trying to claw his way back into your life.
