She has come back India now and is totally unhappy with her husband and in laws. I have been reading that divorce laws in India is totally based upon religion and 6 grounds like adultery etc..if wife doesn't like her husband, since he doesn't treat her well and gives her enough respect and happiness,cant she divorce him??

Answer: Contested Divorce or unilateral Divorce in India may means anytime five to ten years or even more. Most in use ground for divorce is cruelty which include both physical as well mental,the conditions which can be taken in account if these amount to cruelty or not depends on the complete facts of the case,but what is the basic requirement that there is a complete breaking of the matrimonial home with no chance of compromise to live together between the parties also termed as 'irretrievable breakdown of marriage' although irretrievable breakdown of marriage is not a ground by itself but it has to be seen from the facts of the case if the act of cruelty was such that it resulted in irretrievable breakdown of marriage or not. The process of family/marriage counselling is preferred for rejoining the cracked relationship between the parties but how far these succeed depend on the seriousness with both parties take it. The issues such as Alimony or Maintenance, custody of child,settlement of any form of properties given at the time of marriage to both, streedhan taken by the wife with her at the time of marriage etc are settled during the complete divorce proceedings cost both time & money for both parties. The best course to settle all these issues is out of court & move for joint petition for divorce by mutual consent which get settled in a very short period of time of few months.

Answer: Disposition, in a legal context, means the sentencing or other final settlement of a case heard before a court.
It sounds like you are referring to a case which is an appeal case and it means that the appeal has been succesful.
This is because the previous judgement was appealed against and has now been succesful.

Answer: If you were an adult at the time, it probably won't happen. Assuming the judge gave you probation or made you pay a fine for the offense, it will be on your criminal history for quite some time.
Also, it doesn't really matter what state you live in either. The charges will show up on your criminal history if it is ran.

I cannot understand why you would plead "No contest" as it seems to not have much difference on a criminal record than pleading "Not guilty"....

Answer: You can't plead "no contest" in the UK. Here, you have to plead either "guilty" or "not guilty". If you refuse to plead either of these, the court will take it as a plea of "not guilty".
In the US and other places when you can plead "no contest" the effect in the trial is exactly as if you'd pleaded "guilty". You might get some leniency but it should be no more or less than you'd have got by a guilty plea as both of these please will have saved the court's time, reduced pressure on witnesses etc.
The advantage is that, unlike a guilty plea, it can't be used as evidence against you in a later civil case.
So if a man admitted assault, say, and was convicted after a plea of guilty, his victim could then sue him in a civil action for damages and wouldn't have to prove the assault. If, however, his plea had been no contest, the victim would have to prove in the civil case that the assault had taken place and could not really on the criminal proceeding

Answer: If i remember your circumstances right they didn't charge you with anything lewd or lascivious, just a curfew violation. So no, they can't take your residence card for one count of petty theft. Once you get it removed ( only felonies get expunged) you should be fine.

Answer: If your friend has a 341 Meeting of Creditors you should attend.
Most bankruptcies are "no asset" cases. If this is a no asset case, then you won't receive a distribution from the bankruptcy estate.
If her case is an "asset" case, then you must go to the court and file a proof of claim. Proof of claim forms can be found on the bankruptcy court's website. i.e. google "san francisco bankruptcy court or los angeles bankruptcy court" and it should take you to the proper court.
Once you file a proof of claim, any assets from her bankruptcy estate will be distributed to all creditors in order of priority. It sounds like the money owed to you is unsecured. Unsecureds get paid last in line.

Answer: It's kind of like pleading "not guilty" to a crime that you know you commited. If you plead guilty, you accept the punishment without a chance to argue your case and possibly get off the hook. He's contesting this because he's not going down without a fight.

Answer: It means they are re-opening your case for some reason (new evidence, a supervisor didn't like the decision or something like that). If they decide that the decision was incorrect you'll be given a chance to respond at a new hearing.

Answer: It depends on where you are. Assuming the facts you gave and assuming there are no other relevant facts, it can take anywhere from a few hours to a month or two.

Answer: So you are saying that the child's mother gave the child up for adoption without having the father sign away his rights, and now the father is considering contesting the adoption as illegal? Personally, if the child is old enough to have an opinion about staying with her adoptive family, I would probably just let it go. The father hasn't been involved in this child's life for any number of years, so to rip her away from the family she has known just because the father is angry about an illegal adoption is not in the best interest of the child. If he had wanted to raise the child, he should have been more involved after the child was born.

Answer: It depends on how prevalent the influence of clerics are in their country.

Question: How can I contest false "Particulars" in a divorce case? My partner's mother has recently received papers from her separated partner filing for divorce. This has been amicable up until the papers came through. Every "particular" on the list is a false claim. How can she contest these particulars and let the truth be known?
Also, he has got several details in the papers wrong, including the date of birth of his youngest child. Does she HAVE to sign these papers or can she contest them again?
Answer: The best advice would be to speak to a qualified solicitor. She is probably able to "reply" to the particulars to make it clear that she is not agreeable on the matters. If there are things that are not correct or she is unsure, the best thing to do is to find out before signing something.
