I had filed for divorce in WI in Dec 2007. Three days later she was personally served through a process service in MI and later sent summons to appear at the pre-trial scheduled for April 2008. I had met all jurisdictional, residence and service requirements thoroughly in this process.
She never appeared in court thereafter, instead went back to India where we hail from to make up false cases of harassment against me. These cases have hence been stayed by the high court in India finding them baseless, frivolous, malafide and fabricated. Further, these cases were initiated as a retaliation to my divorce petition here in the US and I was constantly harassed to withdraw the petition which I refused to do so.
In June 2008, I served her the order to appear at the final hearing scheduled for August 04 in India properly. She refused to attend the court once again and on the said date, I was granted a default decree. In Sept 2008, I got my judgment and a certificate of divorce in December 2008 from the WI public records office.
The judgment ordered her to pay for half the marital debt amounting to approximately $ 10,000. She also got a copy of the judgment.
She came back to the US in August 2009 and I tracked her down in KY. I filed for contempt of court in WI in Oct 2009 for failing to pay any money she owed and served her through a process service in Nov 2009. She contacted my attorney within three days of service offering to settle the matter for 3000-4000$ and withdraw all cases on me in India by admitting her guilt and that those were all false cases.
She has back-tracked now, hired an attorney and filed a motion to dismiss the initial divorce decree claiming that US never had any authority/business/jurisdiction to grant a decree dissolving the marriage performed-registered in India to Indian citizens under Hindu Marriage Act, 14 months after the decree has been passed and order made. She had never appealed or attended or filed a motion for re-trial all this while when she was fully aware of the divorce proceedings. I assumed this new motion is again a counter-blast to my contempt petition.
While we are both Indian citizens, I have been in the US for over 10 years now including over 3 years since the date of marriage. We have never lived together excepting for one month right after the wedding. She was here in MI for 4 months after the wedding until I initiated the divorce and is back again in KY for the past 4 months. Further, both Indian and American law concur that habitual place of residence of the petitioner post-marriage pending residence requirements defines marital jurisdiction.
In this context, please let me know if there is any chance the original WI divorce decree/judgment passed in Aug/Sept 2008 will be overturned/dismissed and does my contempt petition still hold hence?

Update: She has dropped the India and Indian citizen part apparently becuase it does not hold.
Here is what I got from the notice: She has never lived in WI, never has physically been in WI and has no connection to WI in any way, shape or form. Hence the said WI circuit court does not have jurisdiction to grant a divorce or issue a contempt notice on her although the petitioner lived in WI .
Is this a valid argument for dismissing a divorce a year and half after the decree was passed?
Answer: I understand that you may want a quick answer here, but for complex legal question such as these, you really need to seek the advice of a lawyer. The advice you will receive here may or may not be right, and at best will contradictory.

It has been almost three months since the judgment was issued and now there is a dismissal date in place for the case! Her lawyer has not submitted the decree or asked th court to instruct her further on the drafting of the judgment. What can I do???

Answer: You can take it to court, with proof of attempted delivery. The judge can finalize it for you.

In one sense, Decree and Destiny mean the same thing. In another sense, however, Destiny means to predetermine or preordain, while Decree means to execute or put into effect. To be more precise, Destiny means that everything that exists, from subatomic particles to the universe as a whole, is known by God Almighty. His Knowledge includes all space and time, while He Himself is absolutely free both of them. Everything exists in His Knowledge, and He assigns to each a certain shape, life span, function or mission, and certain characteristics.
Consider the following analogy: Authors have full and exact knowledge of the book they will write, and arrange its chapters, sections, paragraphs, sentences, and words before writing it. The universe’s exact measure and balance, order and harmony, as well as that of all it contains, clearly show that everything is determined and measured, created and governed by God Almighty. Therefore, Divine Destiny exists. Such assertions as determinism, which is upheld by many people and even some Marxists, to explain such an obvious universal order and operation are tacit admissions of Destiny. But we have to clarify one point here: According to Islam, absolute determinism cannot be used in the context of human action.
All seeds, measured and proportioned forms, and the universe’s extraordinary order and harmony, which has continued for billions of years without any interruption or deviation, demonstrates that everything occurs according to God Almighty’s absolute determination. Each seed or ovum is like a case formed by Divine Power into which Divine Destiny inserts the future life-history of a plant or a living being. Divine Power employs atoms or particles, according to the measure established by Divine Destiny, to transform each seed into a specific plant, and each fertilized ovum into a specific living being. This means that the future life-history of these entities, as well as the principles governing their lives, are pre-recorded in the seed or the fertilized ovum as determining factors and processes.
Plants and living beings are formed from the same basic materials. However, there is an almost infinite variety between species and individuals. Plants and living beings grow from the same constituent basic elements, and display great harmony and proportion. And yet there is such abundant diversity that we are forced to conclude that each entity receives a specific form and measure. This specific form and measure is established by Divine Destiny.
Answer: My dear friend it appears that you are utterly confused in the meaning of the Arabic word and the meaning which is prevalent among those who claim to be scholars of Islam. The word 'Qadar' have also appeared in Al-Quran several times though you afiled to notice even a single one and then quoted the verses whch according to your understanding are comensurate with your understanding. In order to understand the Arabic language of the Al-Quran I guess the best way is to ask the Quran itself. So I would like to draw your attention towards 33:38 (Chapter:Verse) and notice that 'Qadar' is used to define the commands ordained by Allah. As something that had been ordained by Allah to be done. The point to note here, as you have mentioned yourself, the destiny for all other creatures has been defined except for the humans. However, read 22:18 and notice that all creatures submit fully but not all among the humans does the same, meaning clearly that the humans have the will to change chose their own 'Qadar'. The important thing to note here is that whither one obeys the commands of Allah or not that person still is forced to act according to what is written in the Quran; Read 3:83. It is very simple to understand, whereby a person whither follows the command or not his/her action according to the charachter they adopt is already mentioned in the Quran (as to how they'll act or what they'll do or say). There is no way one can show any other character trait other than what is mentioned in the Quran. And this is the reason why even without having the understanding of the verses of 'Qadar' you understood what is written in the book is the 'Qadar'. Hope you have been answered read 6:104-105.

The Judgment was set aside on 5/27/08 because I the respondent was never informed by the Husband. The Judge order us to go through mediation since 7/21/08.
Since this time mediation has been set each month to present.
Everytime a date is set for mediation, the Husband/Peitioner keeps canceling the meeting saying he has cancer, needs his prostate, lung and kidney removed and new he has to get a kidney transplant. He still has all my furniture, clothes and other items - he won't let me have.
The husband allegedly is in the hospital. He said he had a lung, kidney, and prostate removed. Now He is supposedly getting a new kidney. (I have research on the internet and it takes 4 yrs to get a new kidney).
I want this divorce finalized. Do any Attorney or Paralegals have any idea?
Answer: I'm sorry to say this but even if he does go to the mediation it is highly unlikely that the divorce will be finalized due to his illness. First you have to make sure that what he is saying is true, by asking your attorney to have him show proof of his illness. I know my divorce was prolonged when the doctor found lumps in my breast, being that I had cancer (luekemia) once the court prolonged the finalization until I could give them a definate answer on whether it was cancer or not. THANK GOD IT WASN'T, it fianlly was finalized 5months later.

Answer: File a Petition For Emergency Appointment Of Commissioner (or whatever your state calls it).
This is a person who is empowered by the Court to sign documents on behalf of the other party, when that other party is incapacitated or unavailable, or refuses to sign documents that are required by the Decree.
I have never heard of the "48 hour" thing (unless it is particular to your state). A party generally has 30 days to appeal a decision; however, the Order is enforceable during that time (unless someone applies for AND receives a "stay" of the Order).
Make sure your realtor explains the situation to the Buyers, so that the offer doesn't expire.

Answer: If a judge has signed a Decree of Divorce, the period during which a person can appeal a decree will depend on the state that you're in. In most states, a Decree will be final for all purposes after a period of time.
A decree can't be changed unilaterally. She might have a right to appeal the decree, but otherwise, once it is final, then she must abide by the terms of the decree also. Most decrees are also written in such a way that they operate to effectuate any transfer of property in the event that one of the parties refuses to cooperate.
Your lawyer is the one who can answer your specific questions. Since you have an appointment with an attorney, don't stress and discuss it with him/her.

Answer: First of all, it depends on where you live.
Secondly, understand that IF she signed the paperwork and the Judge agreed and signed the order, it is mostly that she cannot renig on the deal. Read the fine print as they say and find out.
Don't stress yourself though, okay? She is NOT worth it. I know what you are going through, trust me. I have been there and done that one too. Just go see your lawyer and kick her a**!
She went to jail for dem violence well then that is on her.

Question: What is a divorce decree in Illinois, Cook County? Is it the 6 page "judgment for dissolution" that was signed by the judge at the final hearing? This document details everything about my divorce as well as personal info - stuff that I want private! Sometimes I'm asked for a copy of my decree and I not comfortable with submitting that detailed, personal document. Isn't there a "decree" that I can submit that says I'm divorced without having to reveal all my divorce details - something like a marriage license (name, dates, city, and that's it!)? For example, to change back to my maiden name on my Old Navy credit card, they need a decree copy - but I don't feel they need to know about my child support, life insurance, retirement accounts, etc!

I'm building a unique Counter Fairy deck and although it's strong, any cards that prevent me from using my Counter Trap Cards pretty much shut down my ability to swarm.
So far I've thought of Prohibition in general, but it's a normal Spell Card and you pretty much have to guess.
Double Snare seems like the best bet, but unless I have MST, Magic Jammer, or Solemn Judgment on the field it wouldn't be of much use.

Answer: I wasn't even going to answer this, but I have to clear some stuff up.
The majority of the cards that people said would work against Jinzo actually don't work. Divine Wrath and Pulling the Rug WILL NOT work against Jinzo as his effect is a Continuous effect and never activates. His effect is just there and they have no effect on him. Pulling the Rug will work, but is only a temporary solution as it only sends Jinzo back to your opponents hand. There are not many good solutions to take care of Jinzo. You can do any of the following and it will work against Jinzo, but will need to be setup in advance. So you just basically need to be prepared for him.
You can have Mind Control and take him and use him for a Synchro Summon.
You can have Brain Control or Enemy Controller and take him for a Tribute or Synchro Summon.
You can have Enemy Controller, Book of Moon, Shrink, etc. to either change his battle position or alter his attack and destroy him in battle.
You can include any destruction card in your deck like Smashing Ground, Hammer Shot, Fissure, etc. to destroy him.
Any monster effect like D.D. Warrior, D.D. Warrior Lady, D.D. Assailant, Caius the Shadow Monarch, etc. that would either remove him or destroy him will work.
As for Decree, you need to Side Deck against it as it is your major weakness. All the normal cards you would usually run will work. Heavy Storm, Giant Trunade, MST, Twister, Mobius the Frost Monarch, Caius the Shadow Monarch, etc. Prohibition would work as well, but it is definitely a Side Deck card. Never Main Deck a card you don't know whether or not will be useful. Side Deck to be prepared and, if you happen to run into Decrees or Jinzos, then you Side Deck it.

My ex-wife has stated that she was unable to put up with the kids any longer and insisted that I kept the kids more. As a result, I arranged with my boss to be allowed to work four days a week and keep the children on the three days that I am off. I did this for four months, until a major disagreement took place between me and my wife. As a result, she refused to allow me visitation that was written in the divorce decree. I went for an extremely long time without seeing my children, because she refused to allow me my rights to see them. I have filed a civil action against her for a Motion to Modify Custody. I have been also, gathering documentations to take to court with me such as my daughter's attendance record at school. Last year she was tardy to school 24 times and had 11 absences, (5 of them were unexcused). My ex-wife lives only three miles away from her school. She has also, tried to limit my acces to my children at school, by telling the school administrators that she has sole custody of the children and that I had to get permission from her to see the children, when I visited them at school. We both have joint custody. Also, she and her girl friend's had me falsely arrested for two counts of assault on females. I was declared "Not Guilty" on the count that involved her, But I got a "Prayer for Judgment,(PJC) on the count that involved her friend. (She ran up behind me and tried to attack me from behind, while I was restraining my ex-wife from hitting me during an argument. This took place at 9pm at night. I threw her friend off of my back which resulted in her hitting her head and drawing blood. I was arrested but was not declared Guilty of either charge. In North Carolina, a Prayer for Judgement withholds a verdict, permanently, provided I complete court ordered requirements. I was not declared "guilty" of either charges. So the question is; What could I possibly expect from the Judge when we go to court? And is it possible that I will be awarded primary custody of my childre? Answer: Your situation is far beyond anything you should seek help with on this board. Of course, the standard answer is that the law will differ in every case (sometimes every county and every state) so the best answer that can be given is that you need to go see an attorney immediately. From all the litigation that has already occurred, it does not sound like you were represented so that is a large part of your problem. These issues will not go away or be resolved until a competent attorney gets into the situation and helps to resolve it. If you have an attorney, either the facts are different than what you may believe or he/she did a poor job. Probably the former based on my experience. Your attorney should explain things to you and do not hesitate to insist on a sit down meeting to ask your questions. You are paying for the time and a good attorney will always take the time to try to explain.
I strongly encourage you not to wait any longer and to get an attorney ASAP. Yes, it is going to cost you something but it will be far cheaper than trying to handle it yourself when you consider how much the various false charges, fines, criminal record, etc. are going to cost you.

Can she? Not to get married again but I think she now has decided it isn't fair or something. I don't know but it's fishy she doesn't want to close on this house ASAP??? The judge signed off on it but is there a so called 48 hour free look or something were it can be voided???

Answer: A Court Order/Judgment is not a "suggestion" or something to be ignored. She can't "void" the Order. She may make a Motion to amend the Order, but until she does that you have the right to enforce the Order.
