Question: Self-incrimination rights? After exposing flaw in system that makes you guilty.? I was wondering what protects me, if anything, if I say do something that is not detected and at the time I did not know was not allowed, but after checking on it I found that in-fact I was not allow. After checking I made people aware of what I did and they then tried to make me do stuff because of it, stuff that if I had not said anything wouldn't have been done. They even confirmed that I was not on a list saying I did it and I was a problem in their system. Is there anyway I can act as if I did not say anything? Or some law against them now after me saying something making me do something?
Sorry if it was too vague at first. It is a problem with my school not the government. The problem is I signed up for a class that I need to take but due to personal matters I did not receive a high enough grade in that class to qualify for the class I am in right now. I thought this was the case so I checked on it to see if would get dropped out of the blue. After asking about it I found that I was not on the list of people that did no meet the requirements but after I bought up this point they looked up my records again and found that I in-fact do not qualify and now they are making me take a test to see if I qualify and if I don't I will have to retake the previous class. So my question is, is there something that makes them have to go on what their system told them before rather than now that I brought it up I have to do this stuff. If I would have not said anything no one would have said anything.

Answer: Society needs to be protected against those who would do harm to innocent people, but at the same time, in trying to protect society, individual rights can be trampled on and an innocent person can be punished for a crime he or she didn't do. So society tries to balance the need to protect citizens, with the need to protect the rights of the accused, but presumed innocent.

For the reason, police officers may not ignore the wishes when a suspect specifically states "I want to exercise my right to remain silent" or "I want my lawyer" BUT police officers can use deception to convince the suspect it's in his best interest to waive those rights. If there was no requirement that society's interests be balanced against the right of the accused, police would never be permitted to ask guilt-seeking questions of anyone without a lawyer being present. But this wouldn't be in society's best interests because it would significantly limit the ability of the police to investigate crimes.
Question: Moral dilemma: What would you do? A madman who has threatened to explode several bombs in crowded areas has been apprehended. Unfortunately, he has already planted the bombs and they are scheduled to go off in a short time. It is possible that hundreds if not thousands of people may die. The authorities cannot make him divulge the location of the bombs by conventional methods. He refuses to say anything and requests a lawyer to protect his fifth amendment right against self-incrimination. In exasperation, some high level official suggests torture. This would be illegal, of course, but the official thinks that it is nevertheless the right thing to do in this desperate situation. Do you agree? If you do, would it also be morally justifiable to torture the mad bomber's innocent wife if that is the only way to make him talk? Why?
You don't have time to send him anywhere, nor time to evacuate and probably cause a panic in the city.
Answer: I guess if you were put in charge of this operation,
then the bomber has put you in a situation where you are forced to weigh the lives of many innocent bystanders against a weapon of destruction that he has single handedly set in motion with the conscious intention of taking many lives.
Do you consider his physical comfort leading up to a cataclysmic loss of life or do you create sufficient discomfort to make him disclose the whereabouts of the weapons?
By his act of blatant disregard for his fellow humans and willingness to tear bodies limb from limb, maim and handicap, disrupt peoples lives and create grief and despair thoughout hundreds of families disqualify this individual from an expectation of the basic human rights we all enjoy...... to be instead subjected to discomfort enough to capitulate?
This is a question I know in my heart I would make in an instant in the situation, but I need to step back from in a hypothetical form, because I don't like what I feel I would be forced to do for the greater good.

Question: 5th Amendment rights? Let’s say you’re charged with a crime…. Murder. The court has some evidence against you but not enough to convict you.
The prosecution knows that the crime was captured on a video camera in your home and saved on an encrypted password protected file on your computer.
I know the court could legally take your computer but could they make you give them the password for the encrypted video file? It seems to me that you could plead the 5th right against self incrimination and not introduce information that would incriminate yourself and the courts would have to make their case based on the evidence that they have?
I have a dinner bet resting on this?
Answer: This very issue has recently arisen. A man is charged with possession of child pornography, and the images are allegedly encrypted on his laptop. A grand jury attempted to order him to reveal the password which would decrypt the files. The man refused under his 5th amendment rights, and a federal judge agreed that the grand jury's order was unconstitutional. This is all very recent.
Question: On judgment day, what sort of due process will God recognize? Will there be the right to counsel, right against self-incrimination, requirement that the prosecutor prove his case beyond a reasonable doubt, right to have evidence obtained in violation of the constitution excluded, and so on?
If not, doesn't that make "God's Justice" inferior to the justice of the Anglo-American legal system?
What about the right to appeal to a superior court?

Answer: You're making a small error in the venue. Jesus will be the Holy and Righeous Judge. (See John 3:35, 5:25-29). The lost have already been convicted, this will be the "sentencing".

I hope it's OK to mention specific cases on here. I've followed the Michael Skakel case, and something's been bothering me about it.
As I understand it, he was charged with a crime that happened when he was 15. At the time the maximum penalty was something like 5 years in Juvenile lockup. Now he's 40 and since he can't be sent to Juvenile, when found guilty he was sentenced to 20 years.
My question is, isn't giving him such a harsh sentence a violation of his constitutional right against self-incrimination? It makes his punishment four or five times harsher than it would have been had he confessed at the time the crime was committed. No appeals have brought this up, so I don't know if it's valid or not.
I do believe he's guilty, but doesn't something just seem very unfair about the sentencing?
Answer: a harsh sentence is never a violation of the privledge against self incrimination. all that self incrimination protects is a persons right not to testify against himself, he can plead the 5th amendment instead.
yes his sentence is harsher now. he would have been better off confessing at the time. but this doesnt violate any of his rights. he had a fair trial and was convicted based on current sentencing guidelines. the fact that he evaded prosecution for so long and remained a free man probably has something to do with the sentence. but to answer your question, no, his term doesnt violate his 5th amendment protection against self incrimination.

Question: If you rec'd 3 separate bills for maintenance for your apt., would you call to complain or just pay them? My daughter & I live in the same apt. complex, we have both called maintenance for things like fixing a garbage disposal, A/C problems, etc. She moved in July 1st & she was recently served with a 3 Day Notice to perform covenants or Quit because of all her friends staying with her & the noise. The friend's left & she stayed, but she just checked her mail & she got a bill for a total of $185.00 in charges.
1.) 7/11/08 They charged her $50.00 for the trip & $45 for the labor for someone to come out & fix her A/C
2.) 10/20/08 They actually charged her $25.00 for the processing service who served her with the 3 Day Notice to Quit
3.) 11/3/08 $65.00 for the trip to fix garbage disposal(it said all he had to do was remove a juice cap)
I've been renting from them for over 3 years & unfortunately, she hasn't been a model tenant since she moved in & there have been complaints. Even though she lives a few doors down, I don't see her very often because she's a little wild, she only comes over when she needs something. So she came over all hysterical asking me why she is getting 3 bills for all these charges that she doesn't think she should have to pay. She has a bit of a temper, so she wants me to call them for her. She told me she was just there today to pay her rent & they didn't even say anything to her. So even after being served with a 3 Day Notice to Quit last month, she didn't even pay her rent on time.
I honestly don't know what to say to them. I was thinking of saying something like, Well, you've never charged me for fixing my garbage disposal & A/C, then I thought about it & I pictured them saying, Okay, well then we'll charge you from now on. I feel like they are just doing this because they don't like her as a tenant & she'll move out on her own. I'm not familiar with rental laws or if they are even allowed to charge her for maintenance calls or this processing service fee. I'm glad I got a maintenance man because my daughter mentioned he had to get that juice cap out & reset the garbage disposal & I don't understand why they are trying to charge for the A/C. Answer: Ok, as far as the AC goes if its somehow her fault that it is no longer working then she should pay for it, however if its not its clearly the responsibility of the landlord.
The garbage disposal is certainly her fault and is responsible for the cost to repair.
I serve all my 3 days, 10 days, lease violation notices myself (as allowed by law) so my processing fees are low, however I do still charge them not nearly as much as a professional service company would charge. But they can charge them (as allowed by the law), the reasoning is they have to serve papers b/c the tenant violated the lease, didn't pay rent, etc. I've had to serve the same tenant multiple times and I would find it very frustrating if i couldn't charge for my time and hassle of printing paperwork, serving them, mailing 2nd copy etc.
I do however think the charge on the disposal is a bit excessive, I have most repairs done in house and as such only charge for the time I have to pay my employee, certainly not $65 worth, that's like 3 hours!!!
To the top post man, what country do you live in? Maintenance is not all included with your rent if its your fault, intentional or not. It is if its not, like say a pipe is leaking or you have mold in your apt from a gutter problem, then thats the landlords responsibility.
I feel I should also point out that Eviction notices are not the same as a 3-day notice to quit. What your daughter received will not be on her record unless they go to court over it.
Question: What happens when you cannot pay timeshare maintenance fees? I have been separated for 7 years and just received two notices about Maintenance Fees with a collection agency. I did not get any other notices/bills, and did not know that anything was due or not paid. The "mortgage" is paid off. Will they take the timeshare to pay the fees? Or will they attach to my home or something? There is no way I can pay what they are saying is now due.
Answer: One thing that most likely won't happen is that they'll take your timeshare. As long as it's attached to your name, you will continue to owe money on maintenance fees and the like.
It is possible that they can put a lien on real property and garnish wages to pay off the debt. These are extreme measures, but they are possible. Do not let it linger because it could also go to the courts where you would be assessed penalties and legal fees.
Find a way to pay it off and then get rid of the timeshare if you are not going to use it.

Answer: They are both dry climate plants. Need sun to flower. More sun, more flowers. They would survive okay indoor next to the sunniest window but not great. To trim, lavenders grow on new woods, so either trim no more than 2 inches and new flowers will grow from there. However, then the plant will eventually become very big and too leggy to be pretty. The other way is to just give it a big haircut at the end of winter and allow new growths and let the old growths die off. In either case, to have a healthy plant you should still bring it out to the full sun after the trim until it flowers before you bring it back indoor. Or else, it may not flower.
Rosemary is easy. Just clip it anyway you like. However, it too needs a lot of hot sun directly to flower. Let it stay inside if where you are is freezing in the winter, and you will have to bring it out to get sun to flower before you bring it back in. Repeat and you will have a, healthy long flowering plant.
Both like their root balls away from cold and on the dry side.
Water thoroughly for both but definitely let it completely dry out. Especially lavenders. Their leaves need to really dry out or else they can have fungus. Give them some fertilisers at a lighter strength 3-4 times a year. They don't need much. Organic fertilizer to avoid buildups.

Answer: Betta, they are pretty and very easy to take care of. They also don't have to be in a huge tank just a simple little tank or bowl. the only down side is you can only keep 1 male in a tank or they will fight. You could keep several females in a larger tank together.
Goldfish require a tank that it at least 20 gallons. They also are very messy.

Answer: Not now. You used to be able to if it was paid via a legally enforceable method, like a Court Order. Gordon Brown stopped it when he was Chancellor of the Exchequer at the same time as he abolished the marriage allowance. Probably coincided with the start of the CSA. Yet another stealth tax by this Government. Stealth tax isn't only inventing new taxes, it's also the quiet erosion of old tax reliefs.
Only consolation is that she hasn't got to pay tax on the money she receives. She would have had to in the old days, which may have meant she went for more money at the start.

Answer: Yes, funds for maintenance can come from separate accounts. If you use your parent's account you will need to add your birth certificate to show the relationship as well as a letter of consent of your parent stating that you are authorized to use those funds for your studies.
