Answer: there's no time frame on 221g cases. it depends on why you were g'd to begin with. there's no way for anyone here to know that, so there's really no way to give you a reasonable answer. however, if the case isn't resolved before the September 30th end date, you lose all eligibility.

Answer: depends on what type of law it is and who you are making it for. A general administrative law would be one for parliament / government runs and how to appeal general decisions made by governmental bodies. To make this type of law, parliament can make a statute or judges can make common law or precedents by the decisions that they make. A by-law could be made within a council etc. for a council to make a law they need to hold a public meeting depending on their own constitution per se. Answer: Under the Patriot Act - there does not have to be a trial. There is no right to due process, an attorney, fair treatment as a prisoner, or any other right. You do not have to be proven a terrorist - only arrested for it. Over the last month - I have witnessed the Patriot Act mentioned at least 10 times (on TV cop shows) as a threat to get people to talk. The simple truth is - under this act - they can arrest you in the middle of the night - they would take you away - your family nor anyone else would know where you are - and you would never show up again. They can hold you forever - without ever charging you with anything OR proving you did anything. No one would even know that you were arrested!! That is a form of Administrative Detention.

Administrative Agency rules have made slaves of states, by providing funding conditioned on action or activities predicated by the Agencies, without regard to the proper relationship between the States and the federal government (10th Amendment).
The "continued growth of the Government, particularly in the executive branch", demonstrates the folly that we find ourselves in. Answer: I am frustrated by the relatively small amount of attention APA notice and comment periods are given. The EPA uses the APA all the time in generating regulations, but you never really hear about it on the news, in the newspaper, or on the radio. Unless you know that the EPA (or other administrative agency) is opening a notice and comment period or are a member of a group that monitors a certain administrative agency, you are likely to miss it.
I think (and the EPA has started doing this) a person should be able to review and post comments online. Of course, this presents the problem of people posting comments that are off-topic or uninformed. However, if an administrative agency could come up with an effective notice and online system, it would greatly increase individual participation in important regulatory matters. And isn't that what a democracy is about?

An appeal of an agency ruling? Its impossible to answer this without knowing the fact pattern. PLEASE, if you are going to ask people for help here, give them enough information to assist you or to point you to the proper area for a response.

Answer: Case management hearings are just placeholders for the case. Basically, if it is going to be awhile until the next hearing, the court will set a date for case management where the parties discuss the status of the case...

Answer: are you a citizen or permanent resident? If you're a citizen, no problem you can go to any province. You have to change your license plates, driver's license, health card (remember there's 3 month waiting period before it starts to kick in if you're moving to another province). If you're a landed immigrant under the provincial nominee program, that's different. You have to ask Quebec gov't when you can move.
Question: Why do they put workers who do things wrong on “Paid Administrative Leave?”? Why not unpaid administrative leave? Now grant it that it is usually done during a pending investigation of the person, but ultimately, despite that, isn’t it really in effect the same as a mini vacation? Plus, what if the person is guilty? It is not like they take back those free checks they gave the person - and it rarely results in the person getting fired.
So, instead, they say the person “can’t come to work” as if it is a punishment or something, (well, who wants to come to work anyways)? So, they make the employee stay home and just collect checks? Is it me, or is this concept strange to you? Or am I misunderstanding how this works? If so, please enlighten me, and if I am not, then do you agree with this procedure?
Answer: I believe the law says that until you can prove wrong doing, you have to pay the person. They usually put them on paid administration because for some reason or another they don't want the person around just in case the accusation is true. Such as child abuse in the school, if there is any doubt that the adult,(teacher) did it they don't want him/her near the children. Hope this tells you something you wanted to know.

I am aware that under section 553(e) of the administrative procedures act, government agencies must give an individual the right to petition for a rule. I would like to know what an agency's responsibility is once they have received the petition. Can an agency simply ignore a petition, or do they have to address the specific concerns? Is this an effective way to influence governmental actions?
Answer: if the agency in question falls under the act you have noted then no they can't just ignore it. if they fall under the act and you have met all the standards and followed all the rules governing the petition then they must consider your petition. they do not have to act on it in the way you have intended but they must consider it.
