Answer: Have they found a way to send you mail through the telephone? Because that act doesn't deal with posted mail at all. That's why it has telephone in the name.

Answer: As is typical the Obama/Pelosi/Reid answer to fixing problems is to punish the many for the sins of the few. Everyone is being punished by higher rates because "fees" have been limited and interest rate hikes must conform to new rules Congress has legislated. The legislation was sold to the American people as a way to limit excessive interest rates, but fails to meet the advertised hype.

Question: Does anyone have experience of how much protection you have from a credit card when booking a package holiday? Obviously the cost needs to be over £100 (and less than £30K!!)...the consumer credit act gives information about purchases, but when it comes to holidays, things are less easy to understand. Question: Dell won't let me cancel my credit card. Legal help? I have had a Dell Preferred Account (Credit Card) for about 3 years and I have always paid the balance and never missed a payment. I have a $4000 credit line. In March, I tried to place an order with the account and it was denied. I called them up initially trying to get the account working. But after multiple runarounds, I just want the account closed. I have called about 5 times, every time escalating it to a manager. They always tell me that the account verification failed and there is nothing I can do to verify it. It's been three months.
Is it legal for Dell to keep my account indefinitely open with no way to access it or close it. I looked at Consumer Credit Protection Act a little bit but have no idea where to go. Even if it is legal, what's the best way to go about canceling. Every phone call is an hour and half the time they hang up on me.
The reason I want it is because it counts as a revolving account and I already have enough of those. :) Thanks for the help!
Answer: Well, if there is no evidence of identity theft, it is not a good idea to close the account. The very fact that you have it (and have a 0 balance I'm assuming) helps your credit score immensly and it will hurt it to close,
But if that's what you want to do, you can file a report with the three credit bureaus to get it removed from your credit report, then it doesn't matter what happens to the account because you are no longer, on paper, associated with it.
BTW- you should be contacting the bank that issued the card, not Dell.

Question: Does using a Visa debit card afford you the same protection as a Visa credit card? Many years ago I got myself into some trouble through abusing credit cards. I then decided they were spawn of the devil and made the decision to never have one again.
I'm now looking at making a couple of significant purchases soon and the appeal of the added protection from using a credit card is quite attractive.
I understand that generally debit cards wouldn't offer this protection as it's the consumer credit act that obliges credit cards to provide it and that doesn't apply to debit cards as there is no credit involved.
However I have been told that Visa extend this to there debit card customers too, I'm not too sure how true this is though. What research I've tried to do has been encouraging but it's one thing being reassured but something completely different when you try to make a claim...
Does anyone have any knowledge/experience of this?

Answer: As with all these things, you need to check the individual terms and conditions for the cards in question. Although normally credit cards do offer you more rights (under the consumer credit act 1974) the competition between the banks and card issuers mean that some debit cards now carry excellent benefits by way of insurance and additional protection. Its not just a case of looking at Visa and MasterCard, you need to look at the specific Terms and Conditions for that actual product (card) with the issuing bank.

Question: Are there any consumer protection acts that could protect me from being incorrectly billed while renting? I rent from a large entity. They sent me a refund of $50 in error. They added this amount amount to my bill. I never paid the amount and told them I dispute it. They ignored my requests and charged me a late fee each month. They say someone cashed the check, and it is my responsibility to find out who cashed it. When asked, they said they didn't know how I could find out. I asked for a copy of the cashed check, and was told they had it and would get it to me, When they could. They said they will evict me if I would pay. (And are refusing to cash any checks that are not for the full amount.
Yes, I can open a case at small claims court. But Are there any consumer protection acts that might help me? I Looked at the FCBA, but that is for open credit lines. The FDCPA is mainly for bill collectors, and I don't think this company will meet the requirements.

Rebecca: Failure to pay rental payments can only possibly effect your credit score if you get a judgement against you. Which is clearly unlikely from the stated information. Furthermore, Even if it did, I'm not sure it would convice me to pay money, I do not in any way owe.
Answer: You never say if you actually got the $50. If you did, it might be easier just to pay it back instead of fighting.
However, if you did not receive it or what to fight with them anyway - just don't pay it. I would write them a certified letter (and keep a copy and the receipt) telling them you dispute their claim and that if they report any false and/or harmful information to credit reporting companies or take any action to evict you that you will take immediate legal action suing them for any and all damages.
Next, keep sending the rent checks on time, and be sure to show up at court for any eviction proceedings with your lease and proof of rent payment.
There are consumer protection against reporting false information to credit reporting companies and eviction proceeding have to be done in open court.

Do you use each other's credit cards when paying for goods or services to benefit from the protection offered by S75 Consumer Credit Act 1974? My husband and I were buying something and I paid for it using my credit card (in my sole name) but my husband signed the reservation agreement. The supplier ceased trading so we looked to my credit card company for reimbursement under S75 but they are now saying that there is no "debtor-creditor-supplier" relationship as the payment was made on my creidt card but the goods/services were being supplied to my husband. As we are married we thought nothing of it. I just wanted to know whether in the "real world" people think of such things when paying with credit cards. Anyone else had similar experiences?

How is this type of legislation so RADICAL?
Answer: I think it's because of Obama's moderate governing that so many people don't like him. He is liberal compared to Bush, and the conservatives hate that. He is conservative compared to the far left, so the liberal hate on him too. It's very irritating and immature IMO. I think Obama wants to create a sense of unity between the American people, but a lot of political extremists seem to be undermining his efforts.

Answer: Good points made...the far-right-wing are protesting without anything valid upon which to base the protests. So far, consumer protections seem to be paramount for the Democrats and the Obama administration, which would benefit the ones ranting about "big government" (the Republican buzz words for "get rid of fatcat corporate regulations that protect consumers and our economy, but call it something that the public will fool itself into believing it actually wants"). I keep telling these naysayers and ranters to go to the whitehouse.gov website and everything that is being done on their behalf is right there for them to see (read)...but my instincts say they are enamored of griping and would rather remain uninformed.
For the people who have convinced themselves that President Obama did not respond to the Deepwater Horizon explosion and subsequent oil spill right away, I refer them all to the CHRONOLOGICAL LIST of all actions taken, beginning with April 20th at 10:35 p.m. when the explosion first occurred and President Obama immediately sent four helicopters, two Coast Guard cutters, the National Oceanic and Atmospheric Administration (NOAA) for trajectory support and scientific and biological support services, and the Deputy Secretary of the Interior David Hayes (replaced the next day with Interior Secretary Ken Salazar). He also assigned Rear Admiral Mary Landry of the Coast Guard as the On-Scene Coordinator, replacing her once the oil spill began with her superior officer, Admiral Thad Allen---and this is all by April 21, with other actions taken each day. I do hope the ones determined to be negative at least take a look at the detailed site.
The banking reforms President Obama wants passed the House last month and are waiting for the Senate to "get 'er done" now---the Republicans have been inexplicably blocking this needed change! My guess is that the Financial Reforms will be completed before the end of this summer. Guantanimo will also be fully closed, I suspect. The hold-up has been both funding (with the pay-go in effect) and maximizing the security at whichever prison is chosen (at least two have bid for the job). We finally elected ourselves a LEADER who is willing to throw political caution to the winds and stand up to fatcat corporate interests on behalf of the American people...why isn't this more VALUED by the Tea Potty folks or the people who've been complaining about corporations running our government??? I think they're either fickle or hypocritical on these issues.
