Answer: If your summary is accurate, he PROBABLY won't have a chance at 50/50 for temporary or permanent custody.

Answer: In 1985 amendments to Minnesota Statutes modified the spousal maintenance statute to require trial courts to consider the standard of living established during the marriage when awarding spousal maintenance. The 1985 amendments also added language requiring an award of permanent spousal maintenance where there is uncertainty regarding the need for a permanent award. In short, if there was any question whether permanent spousal maintenance was necessary, that uncertainty was to be resolved in favor of a permanent spousal maintenance award.
This begs one to question why a SOL applies to TWO households where the expense was for ONE before. The ONLY way for an ex-wife to enjoy her previous SOL is at the expense of the husband.
Another thing of which few are aware is that "child support" guidelines were raised at the same time that alimony was starting to be used less. In other words, alimony was replaced by increased child support amounts. Alimony is still available to single, motherless women, however in many cases.
The difference is that alimony is taxable to the recipient whereas child support is taxable to the payer. The result is more disposable income for mothers who also gain from the tax breaks available to the "primary parent", which is an impressive amount. Single mothers receive far more back than she paid. That means it is a form of income, not a tax break at all.

Answer: What did the judge say? It doesn't matter how long the marriage lasts. The only thing that matters is the judge's order. If he said five months, it would be five months. If he says 15, it will be 15 months. And if it says three years, it will be three years. So go back and look at the order and if you don't understand it, get your lawyer to explain it to you.
As for her settling, I don't see what it has to do with spousal support. She will only get the spousal support the court orders and that will be it.
Oh and don't stop it until the court tells you that you can, or you will get in trouble.

Answer: A feasible answer is not possible as long as you do not state the country the visa is going to be applied for and the citizenship and state of residence of the applicant..

Answer: The only thing exempt from child support collections is social security disability.
However, if this is a permanent injury, or one that will continue for more than 3 months, and you have not had your child support case reviewed in the last 3 years you may be able to get a modification. Contact the child support agency to ask.

It depends.
You can ask for spousal or partner support to be paid while your case is going on. This is called a "temporary spousal support order" or a "temporary partner support order." Many counties have formulas for calculating the amount of a temporary spousal or partner support order. Check your court's local rules for the temporary support guideline.
The judge will not use a formula to figure out how much spousal or partner support to order at the end of your case (called the "final judgment").
When the judge makes his or her final order, the judge must consider the factors in California Family Code section 4320. (To find this code section, click here and search for Family Code section 4320.)
These factors are:
The length of the marriage or domestic partnership,
What each person needs,
What each person pays or can pay (including earnings and earning capacity),
Whether having a job would make it too hard to take care of the child(ren),
The age and health of both people,
Debts and property,
Whether 1 spouse or domestic partner helped the other get an education, training, career, or professional license,
Whether there was domestic violence in the marriage or domestic partnership,
Whether 1 spouse's, or domestic partner's, career was affected by unemployment, or by taking care of the children or home, and
The tax impact of spousal support (note: federal and state tax laws were not changed to recognize domestic partnerships.)

However, I think you would better benefit from some support groups in your local community. Go to the local YCC (Your Community Connection) or to Social Services and ask for help. Online support might be alright but not as sufficient than a support group with real life people. I hope everything will work out for you. Question: Child Support - temporary custody please read on!? I am a mom of two boys ages 15 & 20. My 20 year old moved out last year and is on his own. I am also stepmom to my hubbys 2 boys ages 9 & 10.
Anyway, my 15 year old has come to the age/stage in his life that he wants to live with his dad. His dad has been paying me child support off and on -still owes $10,000. (Anyway, I was not going to argue over the fact that he wants to live there and making necessary changes. ) I know kids must make their own decision and learn on their own.
Anyway, his dad is worried about getting child support. He called today stating he talked to (child support agency) and is requesting a copy of a letterfrom me stating I am closing the case. I told him I am not closing the case - IS HE NUTS? I replied "that I went many months without myself.
First of all, I have had him here for past 9 years myself since divorce - since this is new thing - I consider this a temporary arrangement for the school year to assure this is indeed what he wants.
His dad tends to disagree and wishes the case to be closed so I can pay child support. What are the legalities to this? Not that I don't want to help...however he does still owe and I do not think he should get off the hook.
I would think they would consider that and could perhaps have him pay very little or waive it for the time he is there. IS THAT FAIR ENOUGH?

Answer: I'm originally from oklahoma.. Custody and support are two diffrent issues. However, From my knowledge if you choose to give physical custody of your 15 year old son to your Ex, regardless of his past owed support.. to which he will still have to pay you will be required to meet the standards of care for a non custodial parent. So yes he will have to pay you your back child support, but in return he can also make a case against you for current child support owed to him. You can go to an attorney or DHS and sign waviers to prevent this, but it has to be done under mutual agreement.
Question: Can a woman ask for temporary spousal support if she has been married 11 years in Texas? She is totally disabled and has been living on a small inheritance that is about gone. They have been separated for over 4 years and he is just now asking her for a divorce.

Answer: She can ask a judge, but know that in Texas it is rather rare to award any kind of spousal support without just cause. Best to seek advise from an attorney who specializes in divorce and/or family law. Texas courts may order temporary alimony during the pendency of the divorce (from the day of filing the petition until the day the divorce is granted) How much is ordered depends on the earnings and expenses of each spouse as well as which court your case is set in.
Where the marriage has lasted more than 10 years, or under some family violence situations and support is needed to meet the "minimum reasonable needs" of the spouse, the court may order support for up to three years. If a spouse is disabled or responsible for a adult disabled child, the support may continue beyond 3 years.
Question: he stopped paying child support and its only the temporary order? he lost his job at utmb due to the hurricane, now he completelty stopped paying child support even though i know he is getting unemployement money. the case hasnt even gone to court yet for its final hearing and he stopped after only 2 payments!

If he is getting a unemployment check that is close to his regular wages then he is in contempt and can be fined. Don't worry he will still have to pay for the child support that has been accumulating. Make sure your attorney brings up a wage assignment before or during the final hearing
Question: Why Does The United States Provide Haiti With Temporary Aid Instead Of Permanent aid? The united states has been involved with rescue missions to haiti for a while now but that doesnt seems to quite do it...why not provide permanent support instead of temporary support...
Answer: Are you crazy? How many people in the US go hungry every day? How many Americans wish they had health care? How many Americans lost their jobs and their homes during this recession for you to be thinking about donating money to a dump like Haiti. Have you been to Miami and seen what i've seen? Thousands of foreclosure signs left and right and plenty of bums on the street to incorporate their own city. Americans are so brain washed by TV that they don't even know when their thinking for themselves.
Question: Temporary Spousal Support during Divorce...? OK so to make a long story short, I finally decided to leave my loser husband! I am 8.5 months pregnant and I found out he is having an affair, when I confronted him about it he punced me in the face. The police did not arrest him because there was no physical evidence, but I went to the ER and sure enough I had a facial contusion.
I filed the divorce papers the same day and the judge granted me a protection order until our hearing on 10/20.
My question is how will the judge decide how much temporary spousal support and child support I will get until the divorce is final? I am a homemaker and he has a good career bringing home around 7K/per month....however our mortgage is $2850/per month.
Will the high mortgage effect the amount of child support, and temporary spousal support that I get? What if we can't sell the house, what will happen to it in the divorce (I thinking he will not be able to maintain this high mortgage, pay me child support/alimony, etc.)?
We have 3 children (including the baby that I am carrying), and I have been a homemaker for the past 4 years that we have been married. We live in Texas.

Answer: child support should be about$1800.00 27 % of his gross for 4 kids a little more or less. alimony i am not sure on.get a good lawyer. the state of texas frowns on adultery and you can get a lot with a good attorney

Question: My ex has temporary custody. He just had me served for child support. Can he get it? My ex has temporary custody. He is avoiding going to court for the permament order. He just had me served to get child support! He owes his 1st wife over 30K. How can the state of LA take his case.
Its seems unreasonable to me, the state would let him avoid his responsibility, yet go after me. I have been, for the last 2 YEARS trying to get a permanent status change. I currently make about $800 a month. He makes over $50K. He owes me for extraordinary med expenses. He has manipulated the system. FYI--We both have attorneys trying to settle the custody-he just doesn't want it to be permanent, because he would not have control. I don't even have a visitation schedule. He currently "lets" me take our child every other weekend.
This is not about me not wanting to support my child. Its about the abuse this man has. I have a protective order on this freak. Its about him circumventing the courts again and again. He only has temporary custody. Hopefully the hearing officier will see his willful neglect of ending this custody dispute and his willful abuse of the court.

The order is STILL listed as temporary. After he got temp custody, I asked for a pysch eval. We gave the judge the name of a therapist. 3 months, he answered the rule, "No. Someone in the office doesn't like me." The judge asked us for a new Dr. We gave her one. Then 3 months later, he said "No. I don't want this Dr. either. We got a trial date for April 2010. He waited till the week before, to claim he had LEAP testing and could not take off. The court scheduled it the following week. We allowed him to choose the dr. this time since we didn't have much luck picking one out. You guessed it-3 months later, he gives the name of the dr. he wants. Guess what?? That dr. DOESN'T DO EVALS FOR COURT! We got a court date for late Oct. The judge FINALLY ORDERED a dr. she picked. Unfortunately, Its been 2 wks & she hasn't signed the order. I have called the dr., but he will not set an appointment until ordered. I support my kid in many ways-but I am not writing a chk to Mr. Crazy.
Oh yeah, his ex filed. DA, who my ex FIL works for, denied the order. 1 ex is still trying thru the state to collect to avoid power of ex inlaws.
"GoodDad" sounds like you have been screwed over. I was looking/hoping for answers or other ways to solve this issue. Maybe someone had a similar experience and could provide insight. Grow up.
THANKS FOR YOUR RESPONSES!! My ex didn't get a dime. In fact he got a lecture for dragging this case on for YEARS! The best part was when he asked, "How can I feed my son?" The response, "Sir, maybe you need to make a better effort at resolving this case." FINALLY!!! The court has witnessed all the dilatory tactics he has pulled.
Hopefully our next judge will return my son to me and put an end to this crazy mans actions.

Question: Negotiate Child Custody/Child Support Before Or After Temporary Orders are Filed? By the way, this is the state of Texas. I went to court with my ex on 7/28/2008. We completed the "Associate Judge's Report", which outlined what was to be in the Temporary Orders. Well, my wonderful attorney took MONTHS to finally type up the orders. At this time, I have signed the Temp Order, and my ex now has has them and is taking his sweet time.
He is to pay $500.00 per month is Child Support.
Joint Custody...One week on and One Week off.
I want to now change that to Standard Visitation, in turn, I would offer to reduce his child support, by almost half.
Here is my question.....Do I need to try to negotiate with him BEFORE or AFTER my temporary orders have been filed? My attorney says we need to wait until after the Temp Order has been filed. But then again, they took months to get to this point!

Answer: Why would you want to punish your children by reducing their contact with their father? It does seem like the attorney is taking a while, but with the economy in the crapper, women are filing for divorce in droves. The court system is getting overloaded, which includes attorneys.
Why not consider what's best for your children? Either two parents in the home, or Bird Nest Custody.
Question: Will my husband get back money from child support issued in A TEMPORARY HEARING that wasnt for day care? He had a temporary hearing where he has to pay child support which INCLUDES the day care. ( $80 a week.) He got a subpoena from the day care that shows the mother withdrew their son from day care back in November 2009 (they had the temporary hearing september 2009). Since it was only a temporary hearing - will he be able to get back the money that was supposed to be used for day care that was not? The final hearing isn't until a couple months.
Answer: As stated above, he should attempt to apply the difference to an adjustment in future support, but most often it just gets declared a gift. He might have to sue her directly.
Question: Is it LAW that a father owing child support be cut a temporary break while under a doctor's care.? My children's father has paid sporadic support over the years to keep his behind out of jail. Recently he connived a doctor into giving him a medical excuse from work to which he gave to Child Support Recovery Unit and now is on temporary suspension of his obligation. I want to know if this is CSRU's policy or if this is the law. Also I should add that he is a cab driver, under the table and is still working. I have made the nec. reports to this regard but it has no effect. I just simply want to know if this is the LAW or not because if not I personally am going to fire CSRU from my case and take it on Pro Se at the courthouse and press contempt charges against him.
Some ppl have a lot of nerve. In case others haven't noticed the economy is in rough shape. It's hard for 2 working parents to support a family at times let alone a single and DEVOTED parent to raise a family on one salary AND do all the things the family needs done, doctors, sports etc. I do alright by my kids but I live pay check to pay check and could use the child support I'm due. And furthermore I was married to the SOB for 6 years after dating him for 3 and we have 3 wonderful kids. Answer: NO, he can't get relief from child support and I can understand your situation completely, I don't know what state you live in here but I have never heard of such a thing and with CSUR. If you have the paperwork to prove that he is working, be careful when you file, I know this from prior experience that cab companies will lie and cover for their driver and who ever else. So go to legal aid and go from there. I am sorry to hear about your troubles and I gave anwser #1 on here a low rating also A##holes, haven't been there and don't understand.
