Legal Publication
Within our constitutionally based legal system, in order for substantial personal rights (like parental rights), of constitutionally protected individuals (like birthparents), to be terminated or destroyed in a legal proceeding (like an adoption), the affected individuals must be given adequate notice of the legal proceeding, and a reasonable opportunity to present evidence and witnesses in their own defense. The law requires that the most reasonably effective means of providing that notice under the circumstances be used to give this required notice to the party whose rights are in jeopardy of being lost or destroyed. Personal service is the preferred means of providing this notice. When personal service is not possible because the affected individual cannot be located, especially when that is the result of this individual hiding, the law allows the required notice to be published in a newspaper of general circulation that services the last know location of that individual. If this is done correctly, this publication will constitute valid legal notice.
Question: What newspaper(s) can I give legal notice by publication in for Sacramento County, California? I'm trying to privide notice by publication to someone living in Sacramento and need to know what legal publications are out there. The cheaper to post the better.
Answer: You can file a legal notice in any community paper in the county. The weekly papers are usually cheaper to advertise in than the dailies, due to their typically lower circulations. I'd recommend:
Natomas Journal (Sacramento)

The News-Ledger (West Sacramento)

Question: Is it legal to place Movie listings and show times in a publication? I'm working for a Publication and I am designing a Local Happenings page and need to know if it's legal. Also is it legal to post upcoming concerts, sports games and local events in a publication.
Thanks.
This is without direct permission from the event holder. I find events on the internet and go from there.
Answer: yes it is legal to place Movie listings and show times in a publication.
Question: Is it legal to sell a publication to another business if it is a non profit?
this is not a 501 3c only a state registered non profit
Answer: That really depends on what type of publication, type of non-profit, income from publication, etc. Can you provide some more details as to the specifics of the transaction?
From what you've provided, it's completely legal. However, depending on profits the publication generates for the non-profit they may jeopardize their status as a 501 (c) 3 (or other type of org).
Question: Is it legal for a high school principal to deny publication of an article if it has nothing offensive in it? I wrote an article for my journalism class about how juniors are not being given parking spots this year, and I made the argument of why they should be. I said absolutely nothing offensive in the article. My principal still won't allow it to be published in the school newspaper though. Is this legal? Isn't that a violation of free speech?
The reason for it being rejected is because parking at my school is a huge, highly debated topic at my school. The article I wrote covers both sides of the story, but is factual and appropriate.
Answer: Yes it is legal and is not a violation of your right to freedom of speech (I'm assuming you are in the US)
It is a privately run newspaper and they do not have to publish if they don't want to and I suppose the ultimate arbiter as to what is acceptable is the principal or the governing body. Freedom of speech does not mean you have a right to publish your views in particular newspapers.
It might be different if you were handing out flyers with your article on it outside the school property and they told you to stop.
It doesn't mean that it was justified or fair of course. Why don't you complain to the Schools governing body?.
Question: Where can I find a legal newspaper that lists foreclosures, divorces, and probates? I know there is a legal publication that lists foreclosures, divorces, and probates in NJ. But I cant seem to find it anywhere. Please help!!!!!!!!!

Question: Divorce by Publication, legal in Texas???? Wife moved out of town, Texas to California, has been out 9 months, but will not sign divorce papers, wants to keep medical insurance benefits-reason for holding off, but won't communicate, any idea if 'D' by publication is legal in Texas?
In most states you have the option to file a "divorce by publication." Here is the basic steps.
1. Go to your local newspaper and put a divorce notice ad in the classified section. 2. Mail the divorce notice to the last known address of your spouse. 3. Wait 30 days and get a letter from the newspaper stating that the ad was posted for 30 days. 4. If your spouse no longer lives at the last known address the divorce notice will come back undeliverable. 5. Take your noncontested divorce papers with the letter from the newspaper and the undelivered notice and go to your local courthouse and file a "divorce by publication."
There are more steps and more forms to this process. But these are the main ones.
Answer: You can get service on a defendant by publication in Texas in civil lawsuits (divorce included).
The steps are not quite as simple as you state, however. And precision is important. Coming close won't do anything except delay the eventual divorce.
An attorney can help you. So can someone at the clerk's office. Ask them for a copy of the "publication stuff" in another divorce file.

Answer: You are attempting to do what is known as "Service by Publication", which means you have to publish your case summons in a "newspaper of general circulation" in the state of the lawsuit (and quite often, it must be in the same county as the lawsuit, too).
Service by publication costs obviously differ from one newspaper to the next, but you want to make sure you use the paper that is most commonly used in your county for that purpose since it will have the lowest cost. These newspapers are very efficient and professional at doing this (since they do it 1000 times a week) and they will almost always file a "affidavit of publication" for you with the court when the publication cycle is complete (usually once per week for four weeks).
To find the best newspaper to use, type "Legal Notice Publication {your county}" in Google or Yahoo. Cost for publication should not exceed 50$, if they ask for more than that, move on. In my County (Maricopa County, Arizona, which includes Phoenix) the newspaper of choice is the AZ Capitol Times, which only charges about 38$ for publication, including the affidavit.
Yes, when the affidavit of publication has been filed, you are entitled to start default proceedings, usually ten to twenty days after the last publication of the publication cycle.

Question: Is it OK to mention Gromit in a story for publication? My partner reckons that in a short story submitted for publication I can't mention the character Gromit for legal reasons. I think he's wrong. Does anyone know?
Answer: Your partner is wrong. Your story characters can watch Wallace and Gromit as much as you like.
What they can't do is bring Gromit the dog home with them. The one from the show, I mean. They can certainly bring _a_ dog called Gromit home having named him after the show.
Question: Why do some books have publication dates that are in the future? I'm a copy cataloger at a large midwestern university, and lately I've been noticing books coming in with "2007" publication dates. From what I understand about copyright law, the publication date indicates the date that the book is to be made available to the public (as opposed to printing dates or copyright dates). Is it just a matter of getting a book out sooner than anticipated? Are there any legal problems if a book is made available sooner (or later) than its offical publication date?
Answer: I'm not completely sure I understand what you're asking but here goes. The publication/release date is when the book will be available to the public. If the book is put out on the shelves before that date it will affect the authors numbers in regards to # sold that applys to best selling lists, etc. Also, if a bookstore knowingly puts a book out early, they are in violation of their contract with the author/publisher and can be penalized. (of course this usually doesn't happen with the BIG name authors but it does happen)
Question: What is the Government rule to register as publication house in india ? I want to start a publication house in india to print and publish books. what should i do as per govt. rule by which my published books will have no legal problems.

Question: Grounds to take legal action against the publication of unauthorized photos? I was the director and organizer of a private photoshoot - one of the model's friends who happened to be a photographer also came along, and took photos during the photoshoot of my models too. At the time I expressed my concern that some of the models prefer that they did not have their photos taken by this photographer as he was not the 'official' photographer. He respected this and avoided taking their photos. However, after the event and in the best interest of respecting my models, I decided that in order to protect our rights and the premises of the photoshoot, that I would not allow the photographer to publish his photos.
I believe that it is true that the photographer had full rights to take the photos, but the question now is whether or not I can legally forbid the photographer from publishing the photos, and if the photographer does, are there any laws that I may point to and remind him of to dissuade them from doing so.
This photographer argues that because it was not made clear beforehand that none of the photos could be published, they are fully entitled to the photos and doing what they will with them so long as they are not libelous, and they do not make money directly because the models are who they are - and rather because of the makeup jobs and clear effort that went into the photos.
What can I do in this situation? what can they do? Since nothing was signed between anyone involved, I know that this can be somewhat tricky.
Thanks!
Awesome responses so far, thanks! - so if the models are all uncomfortable with having their photos posted up and both they and I clearly communicate that to the photographer, what law are they breaking if they are to post the photos?
As one person mentioned, once they are taken, he is arguing that they can be used for editorial or artistic purposes. Could I make the case that he is also profiting/advertising his photography services indirectly by sharing them with others?
Answer: Same answer as I gave to your other exact same question
Firstly, some of what you are asking depends on what country you are in.
Secondly, if this was a private event then the best thing you could have done would have been to forbid this guy to take any shots and if he persisted then eject him for trespass.
As you allowed him to take those photos then you have little or no comeback.
In the UK. you effectively gave him permission to take the shots by not stopping him from doing so and if there was nothing in writing regarding photography specifically commercial photography then you are again on a hiding to nothing.
In the UK
As the photographer, he has full copyright over his shots and can effectively do what he wants with them. This includes posting them on the web, selling them etc etc. There is no requirement in the UK for a model release for him to do so.
You ask if there are any laws you can point him to to remind him.... There are not - all he has to do is point you to the copyright act and the fact that he can do what he wishes effectively.
Sorry, but if you are going to organise these things then make sure that everyone who attends has a written list of rules and regulations for the shoot and if there are others there not involved then ensure that you have something in writing to advise they are not allowed to take photographs. If they then do so you can eject them for trespass and you would then have some comeback if the shots they took were published.

Answer: What about it?
Question: is it legal to post an article from a magazine word for word on my web site? I would site the publication where the article is from. if it isn't legal is there a way of posting info from a magazine legally without having to call all over the world trying to get permission from each publication? and do the same laws apply to on line articles too?
Answer: It depends WHY you were posting their article. If you are posting it to illustrate a point, for review, for critical analysis, that sort of thing, you don't need to get permission, although obviously you will need to provide credit. That type of use is called 'fair use' and is allowed under copyright law.
If, on the other hand, you're posting the information as filler, to provide content for your site, you need their express written permission, or they can sue you.
Both of these points apply to any publication, whether online or in print.

Question: What are the legal rules for publishing a book of translated poetry? I want to translate some Korean poems into English for publication. Do I need special permission to do so?
Answer: Are those poems in the public domain? Does someone have the copyright?
Translations are "derivative works" so you need the consent from the original copyright owner.
------------------------------
United States, the Copyright Act
17 U.S.C. § 101:
A “derivative work” is a work based upon one or more pre-existing works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted.
17 U.S.C. § 106:
Subject to sections 107 through 122, the owner of copyright under this title has the exclusive rights to do and to authorize any of the following: (1) to reproduce the copyrighted work in copies...; (2) to prepare derivative works based upon the copyrighted work; (3) to distribute copies...of the copyrighted work to the public by sale or other transfer of ownership, or by rental, lease, or lending....
Question: What are the legal ramifications if any for getting re-married without being divorced? I am married to an awol soldier. We have been separated for the last 9 mo. He has been awol for the last 6 mo. I have no idea where he is and cannot afford a publication divorce. I can't use my tricare because he has been awol so long and cannot get on any kind of state health care program because we are still married. I am back in a relationship with my high school sweetheart and we want to get married.
Answer: First I would go to the court and get a court order of abondonment, once that is granted then I would file for divorce. The divorce would most likely proceed quicker with the abondonment order. Of course, you will need proof that he is awol for the abondoment order, maybe even for the divorce decree.
Question: What is the legal definition of a newspaper in Britain? If a local authority is obliged to publish a Public Notice, what rules exist governing the type of publication they can use? I'm asking because Cornwall County Council hopes to save money on advertising by publishing Public Notices and other advertisements in a ''newspaper'' it plans to create itself for monthly distribution to every household in the county. Naturally, local newspapers (with which I have no connection whatsoever) are not happy and neither are many residents who see it as a waste of money.

Question: What are the legal restrictions of using someone else's art/photographs in one's own digital picture? I would like to create some digital images with Photoshop, but I don't have all of the elements I need... Can I borrow them from google images?
What restrictions would this put on the publication of my art?
Can it be put in a portfolio or demo-reel?
I'm relatively certain that it can't be sold, but am I breaking any laws if I post my artwork elsewhere on the internet?
What if I distort their image to the point where it can't be recognized?
Any insight would be great. Thanks a ton!
Answer: The laws regarding copyright and digital work are kind of vague, you should always err on the side of caution though. Instead of using random images you should use stock photos. Flickr and deviant art both have sections of images that are royalty free and can be used by anyone for non commercial purposes. Make sure you are only looking in the stock image or royalty free categories, not every image is free to use.
