The laws covering revocation vary considerably from state to state in defining the availability of a revocation, and if allowable, the circumstances and time limits under which it is possible.

Answer: It depends on what they are trying to revoke. Typically a revocation hearing is to determine whether some privilege granted to a defendant should be taken away. For example, if you are out on bond (bail) and awaiting trial for car theft, and it is discovered that you were arrested for armed robbery while out on bond, they would likely hold a bond revocation hearing to decide whether or not to revoke your bond.
If you are on parole, and you violate the terms of your parole, they will likely hold a parole revocation hearing to determine whether or not to revoke your parole. I am going to assume (since you mentioned a parole officer) that this has to do with an alleged parole violation.
The preliminary revocation hearing is the hearing in which a judge decides whether the evidence that a parole violation occurred is sufficient to bring the matter to a full-blown revocation hearing. If the judge finds that there is enough evidence, an actual revocation hearing will be held. At the actual hearing, the judge will hear all of the evidence and legal arguments, and then decide whether a parole violation did in fact occur and, if so, what to do about it.
EDIT: Oh yeah. Your other question. The defendant should be served with either a subpeona or a warrant ordering them to appear at the hearing. Sometimes this service is performed in conjuction with an arrest. That is, the police might pick the defendant up and keep him (or her) in custody until the hearing. It depends on what the judge ordered in the warrant or subpeona, and/or the statutes governing parole in your state.

Answer: i am pretty sure it is immediate so best to make arrangements to get there and get home after court. why plead 'no contest' better to perhaps plead guilty - you need to discuss the matter with a lawyer/solicitor to make sure. i guess it all depends what the charges are.

Answer: For a contract you need to use certified mail so you get a receipt that it was delivered. Otherwise somebody can always argue that they never received the fax. An office might have 1 fax machine for 20 people to share and things get scrambled. The fax might run out of toner or paper, or somebody might unplug it and wipe out the memory if faxes are pending to print. Get the idea?

Answer: This usually is a serious misdemeanor that carries with it a stiff fine and possibly some time in the local jail. In some states, however, it may be a felony that lands the offender in state prison or with a significant amount of community service to work off, particularly if the suspension or revocation was based upon a DUI.

Answer: It means that instead of allowing him to stay on probation and out of jail, they're looking at putting him in jail.
The 'suspension of jail term' is letting him stay out of jail...the 'revocation' is taking that away.
So, someone is trying to make him go ahead and serve the six months of weekends in jail.

Answer: If he has got his PR and then the divorce I don't think that it will be revoked .If it was under process then it would have caused problems.

Answer: If you drive without a license or a learner's permit, the insurance will not cover you (read the policy).

Answer: I am a insurnace agent in over 40 states. We deal with high rish people in your situation all the time. For the most part your looking at getting your licensed suspended or revoked for a long time. Probably a year. Once your able to get your license back your going to have to carry insurance with a SR-22 filing. Check with the DMV to see when you can get it back and when you will need the filing.

Answer: 1) You have to be administrator to m ake it stick. (That means logging in with the login "administrator". The fact that your login is an administrative login doesn't matter.) Answer: You could, but not easily, and probably not any time soon. If you have a valid driver's license now, and you received the tickets several years ago, your chances would be better. You will have to become a U.S. citizen. If you have a 4 year or an advanced degree and if you have a special skill such as being fluent in a foreign language, your chances would surely be better.

Question: why does the ignition interlock sentence not run concurrent to the license revocation? On 9-1-2004 I pled guilty to dui 3rd. From the 9-1-04 my license was suspended for 30 months. It was also required that I have a Ignition interlock device installed not begining until 3-1-2007 for 36 months after this date. In a nut shell the ignition device has not been running concurrent with the suspension. Is this something I can motion the court on to allow me to get rid of the device sooner.
Answer: No. You can't drive at all during the license revocation. An ignition interlock would be pointless. The ignition interlock is for the first 3 years after you get your license back.
Question: I have a revocation hearing, because I missed an appointment with my PO. What may happen? I have done everything asked by the courts, and payed my fines down from over $2,000 to a little over $200. Personally I think it is a vendetta on my PO's part, but that is irregardless. Answer: My wife is District Court Clerk. She says whether you are on parole or probation makes a difference (PO could mean either one) . In both cases, the results could range from a simple reminder of your responsibilities to full implementation of your sentence or punishment. A lot will depend on your answers, appearance and attitude at the hearing. Good Luck, and do what you are supposed to do to get on with your life and leave this behind you.
Question: where can i find info on laws regarding probation revocation in Kentucky? My fiance violated his probation. He was originally sentenced to a year in jail and it was probated two years. He served 2 months of the year before being probated and has currently served almost 3 more months. Does anyone know if there is a law in Kentucky where 6 months and 21 days is considered a year? Could he be sentenced to more time than that or are there guidelines that must be followed?
Answer: KY - KRS 552.120(3)
Time he served in jail (2 months) and the time he has currently been on probation (3 months) count toward the two years of probation. There is no law that says 6 months and 21 days is counted as a year. If he should violate again, it is up to the judge how much time he can be jailed, either max or any part of his original sentence. If he should pick up additional charges while violating his probation, he can be sentenced to jail time on those also. those also.
Question: Anyone know about driving licence revocation due to failing eye test? My partner has had to turn in his licence as he failed a "field of vision" eye test. We do not know what he scored on this test, or what he would have had to score to pass. We need to use a solicitor to appeal the process at the Sheriff Court.. Answer: heres how you do this, go to get your eyes checked, if the doctor says his eyes are fine then you can appeal it, if not no one is going to give him a license if he can't see the cars. plain and simple, he needs to get his eyes checked and then you can attempt to get a drivers license

I was just notified that my Minnesota DL will be revoked in 2 weeks and need to take written exam in order to reinstate it after 30 days. But I was wondering if I could take the written exam before my license actually revokes so that I would not have to worry about it later?

Answer: No. In two weeks it is revoked. After 30 days, then you can take a written exam to reinstate it. Just like it says in the notification. Having to "worry about it" is part of taking responsibility after all.
