Answer: I would raise the fact that Abigail, one of her accusers is biased since she had an affair with Elizabeth's husband, John. Mary Warren worked in the Proctor household but was dismissed by both John and Elizabeth, so her testimony would also be considered biased.
Question: How can I legally refuse to give a deposition to my fiance's rival's attorney in a civil suite? My fiance worked for his father's company for 7 years. Now, his father is trying to sue him for setting up a company which he claims was in "direct competition". I looked up the case's progress online today and was surprised to see that they are planning to get me to give a deposition! Do I have to? I have nothing to hide, but I do not even want to get involved in this mess.
Answer: You may be able to plead the fifth. I know you can plead the fifth for a spouse but I am not sure about a fiance. If you are that concerned you should consult a lawyer. What could you say that would be that damaging? Did your fiance have a non-compete agreement with his father? If not, it is not an issue.
Either get married real quick or be ready to talk.
Question: Is it possible to reschedule a legal deposition? I received a notice that I must be present next week for a legal deposition. I will be out of town as of Tuesday and the deposition is scheduled for Wed. I just got the notice in the mail today (Saturday). Is it possible to call and tell them I am out of the state, or will they tell me its my tough luck?
Answer: Contact the court or attorney, there are regulations as to how far in advance you must be notified and I think you may not be obligated since your notice was only a few days.
Question: What happens if you dont show up to a deposition? The person I am suing did not show up to the deposition that was set-up for her to give answers. What happens now? Was she obligated to show? And if so, what can we do to her for not showing?
Answer: you win unless she provides an excuse and a good one she was in a wreck and she is in a coma or she detained by UFO's anyway she forfeited you win by default.she should at least call the court and tell them why . in some states a bench warrant could be issued

Answer: They're both caused by glaciers and one process is the effect of the other. The deposition of loess at terminal moraines is caused by erosion of rock the glacier passes over. The deposition of glacial erratics are the result of the glacier plucking rocks out of the landscape and carrying them alon its path until a time when it melts and drops them.
Question: How to remove the calcium deposition from the lung due to cured TB disease.? I was suffering from the disease TB long back. Now I could see the calcium deposition in my lung. In order to get a work permit, I desperately need to remove the calcification.
Can any body suggest how to get rid of this calcification? If so that would be greatly appriciated.
Answer: In all the materials I have read, the calcified granulomas are impossible to get rid of. You can get a latent TB skin test to prove that you are non- contagious. You could consult with an infectious disease doctor or call your state board of health to see what the protocol is to be cleared for employment. Good luck!
Question: Can I be compelled to attend a deposition in another state? I owned a business in Maryland, an LLC, which was destroyed by fire. The insurance which did not pay off a creditor and they want me to attend a deposition to explain "where the money went". The creditor hired a Pennsylvania lawyer who requests that I attend a deposition at their office.
I understand that subponeas and such don't have to be honored between states. Does this hold true for depositions? If I don't go can I be held in contempt?
Answer: You would be best to discuss with a lawyer. They are giving you a chance to state your side of the story before they sue you. You can skip the trial too if you like, that way the win by default.
These things only get worse when you ignore them.
As a general rule it is your responsibility, not the insurance company, to pay your creditors. the insurance company gave you money based on the amounts you claimed including the creditor.
If the insurance company was required to pay, wouldn't be beneficial for you to make that statement?
Again, discuss with a lawyer.

Question: Can I plea the 5th amendment in a civil deposition hearing? I am going through a divorce, and have a deposition hearing coming up. I know you can plea the 5th amendment in a criminal trial, but what about civil, like in a divorce hearing and a deposition hearing? I want to know what would the implications be of pleading the 5th for every question asked of me during the deposition. (I do not want to ask my attorney these questions) Please keep in mind I know it may not be a good idea to plea the 5th, but can I LEGALLY do it?
Answer: Yes, potentially you could, but not literally on every question. A deposition starts out with background information like your name, address, education and work history. You need to wait until they start asking you substantive questions that could harm you. If you plead the 5th on every question, you'll look like a fool and the other side will take you before the judge who will force you to answer some of these questions. Why don't you want to ask your attorney? If you can't ask him/her, there's something wrong with your relationship with your lawyer. Everything you tell your attorney is confidential and he/she only gives advice, i.e. you're the boss in that relationship. Please don't pull this on your lawyer without advance notice.

Answer: No, you cannot get out of the deposition subpoena. What you can do is ask to be paid the standard witness fee and the mileage to travel there. Also, you can contact the lawyer who subpoenaed you and find out of the deposition can be rescheduled for a time that is convenient to you (maybe a Saturday or evening, after you get out of work)? The lawyer will usually be cooperative and ask that you waive personal service of the new date/time (they'll just send you a confirming letter and ask you to sign it).

Answer: If you need case law on point, you should at least tell us what jurisdiction you are in.
In the US, this could vary from state to state. For example, California has a specific statute regarding who is entitled to be present at a deposition.
It also depends on your definition of "assist".
I have attended depositions where junior lawyers attend to assist the lawyer taking the deposition. These assistants are silent, but locate and distribute exhibits and take additional notes. But your laws may vary.

However only invest what you can afford to lose! should the investment go sour or fail. Stock Brokers as you know charge fees for their service and they are not out of pocket eitherway if your investment fails!
Question: I have been ask for deposition in the defense of a dr i despise. Do i have to do the deposition? I worked for hospital over 4 years ago and a patient I provided care for is suing the Dr. who cared for her. I have been ask to do a deposition by this Dr's lawyer and I despise this Dr. How do I get out of this deposition?

Answer: You only have to show up for a depo if you are served with a subpoena duces tecum. It can be sent by the attorney, but it has to say that it is a subpoena. If you haven't been subpoenaed, you don't have to attend. My question to you is why haven't you just told the dr.'s attorney that you don't think you would be a good witness for them given the amount of time that has elapsed since you worked with him and your dislike of doctor.

Answer: You have to go, and the loophole is for the opposition to gain info to screw you with. Do not volunteer any info, be nice and be brief, make sure you understand the question or they will give you trouble for "lying" and if you are suing someone they will favor the bastard even if he or she ruined your life, and make you look criminal when you may be a victim

Answer: If you disobey a direct court order (such as a subpoena) you may be held in contempt of court. Contempt may be in a fine or confinement. It's smart to contact whomever is trying to subpoena you and discuss why they need you and why you don't want to go. The deposition may be something simple that can be done remotely (deposition is outside of the courtroom so it can be done anywhere you can make a formal statement. . .I guess it could be done on a toilet if you really wanted to do that).

Answer: This is the problem: In general in a deposition only a claim under a privileged maybe evoked to not answer the question,: relevancy is addressed latter to see if admissible into the court by the Judge, but at this stage everything is free and open unless it falls under a privilege

Answer: It's a sworn statement of the facts and must be sworn and signed before a notary public. Make certain you are accurate and truthful because it's the same as testimony in court and can be used as such. If you are uncertain as to what to do and how to do it, you should seek legal counsel because a deposition can make or break a case.
